Sex-ed program pulled from year's curriculum
Washington Post ^ | 06 May 2005 | Jon Ward

Posted on 05/06/2005 5:18:28 PM PDT by Lorianne

Montgomery County Public Schools yesterday halted a new sex-ed curriculum that was to have begun today, after a federal judge ruled in favor of a lawsuit that charged the course is unconstitutional and promotes homosexuality.

U.S. District Judge Alexander Williams Jr. had granted a 10-day temporary restraining order yesterday to halt the teaching of the new course.

"I have directed the office of the deputy superintendent of schools to review and evaluate the materials referenced in the judge's order," Superintendent Jerry D. Weast said, "...before any decisions are made about any future pilot testing of the revised curriculum in our schools."

Mr. Weast also said that he is suspending the use of "Protect Yourself" -- the video where a woman demonstrates condom use with a cucumber -- pending further investigation by the schools.

Judge Williams agreed with the two groups that filed the lawsuit -- Citizens for a Responsible Curriculum (CRC) and Parents and Friends of Ex-Gays and Gays (PFOX) -- who argued that the curriculum is biased toward homosexuality and dismisses religious perspectives on the subject.

Montgomery County Public Schools "open up the classroom to the subject of homosexuality, and specifically, the moral rightness of the homosexual lifestyle," the judge wrote in his decision.

"However, the Revised Curriculum presents only one view on the subject -- that homosexuality is a natural and morally correct lifestyle -- to the exclusion of other perspectives.

"The public interest is served by preventing [school officials] from promoting particular religious beliefs in the public schools and preventing [the officials] from disseminating one-sided information on a controversial topic," Judge Williams wrote.

The crux of the issue was the part of the curriculum which favored some religious sects over others (those favorable to homosexual lifestyle).

This is better than nothing. We must fight lawsuits with lawsuits, or so it seems. But I still get a creepy feeling about all of this. Why can't they just study the 3R's and leave the deviants, ex-deviants and all the various "sexual diversities" out of the schools altogether? Clearly the liberals who control the public schools haven't morals enough to teach out kids anything at all on this subject (and others). So just STOP already.

Montgomery County Public Schools "open up the classroom to the subject of homosexuality, and specifically, the moral rightness of the homosexual lifestyle," the judge wrote in his decision.

If the schools start to teach homosexuality is normal, they'll have to teach all the other "normal" dysfunctional sex practices as well. Kids would be taught how to wrap themselves up with chains and how to whip each other, or do animals, lick feet, and we can't forget the new homo fad on the net - cannibalism.
Teaching all the perversions would only be fair, right?

In fact this is an admission that Homosexuals are not born homosexual they are recruited. That a school district should aid in that recruitment is abhorrent. the Suprintendent and those who participated in this program should all lose their jobs and possibly be arrested for contributing to a homosexual pedophilic lifestyle. What person in their right mind would run this trash through the minds of impressionable kids? Jail is too good for these supposedly educated perverts.Enabling perversion is as bad as performing the perverted acts.

This curriculum did not just teach that homosexuality was just fine but religions that doesn't agree with this are wrong.

Supposedly the judge's major concern was the 1st Amendment violation, the state openly campaigning against certain religions.

I think this is a Washington Times article, not Post.

Of significance, Judge Williams (Black American) is a Clinton appointee. Quoted in a brief biography: he says, "I get personal joy and satisfaction upon making a decision which I deem just and appropriate following careful reflection and consideration of the facts and applicable law.” and he lectures law students "never comprise your integrity."

I haven't read his other decisions, but based on this decision, one wonders how he got "vetted" by the Clintonistas.

This article should be read in conjunction with an article on the Black Caucus, http://washingtontimes.com/national/20050506-122430-5180r.htm

Faith based Black Americans can be the primary force in turning back some of this socialist, moral relativism that is ruining the culture.

Well you know that this decision will be a red flag against him for any higher post - Schumer will call him an "idealogue".

It seems GLSEN has been sent at least a partial setback in their recruiting efforts.

Below is text from the opinion.

It is REALLY dramatic. In fact it is very tight in its legal reasoning along the lines of the 11th opinion upholding the ban on homosexual adoption.

EVERYONE should read the OUTRAGEOUS examples in the curriculum. It even uses the LOOOOOONG discredited 10% of the pop is homosexual statistic that even the homosexual advocacy groups CONFESS IS A LIE. (lawrence brief of the homosexual groups said the MOST is about 2.7% and even that is suspect since ONE experince makes a person a homosexual. ie rape/molestation)

It is also important to note this is a TEMPORARY RESTRAINING ORDER, BUT it does represent the fact the parents are likely to suceed on the merits. I hope they do NOT settle but kill this BS off. The only settlement is to remove ALL homosexuality from the sex ed program. That is other than to say the CDC says that 80+% of all new adids cases is homosexuals.

21
CONCLUSION
Long ago, Justice Brandeis wrote that “the greatest menace to our freedom is an inert people,” and
therefore the righteous end of the State was to make our people “free to develop their faculties.” Whitney
22
v. California, 274 U.S. 357, 375 (1927) (Brandeis, J., concurring). The wisdom of approving a
curriculum which prohibits students from discussing one viewpoint of a controversial subject goes to the
very essence of that First Amendment faith. The merit of Plaintiffs’ viewpoint — be it right, wrong,
discriminatory, or just — is of no consequence. Rather, the Court is concerned with ensuring that Plaintiffs’
free speech rights are not restricted merely because they voice an unpopular viewpoint. No matter the
importance of an idea to its believers, or how objectionable it may be to its detractors, the diversity of our
democratic fabric is sewn together by the belief that the path to freedom lies in the opportunity for rival
positions to be equally heard and discussed.
So, too, will this Court fiercely protect the First Amendment freedoms enshrined in the
Establishment Clause. The Establishment Clause “rests upon the premise that both religion and government
can best work to achieve their lofty aims if each is left free from the other within its respective sphere.”
McCollum, 333 U.S. at 212. Accordingly, this Court has strived to “chart a course that preserves the
autonomy and freedom of religious bodies while avoiding any semblance of established religion.” Walz v.
Tax Commission, 397 U.S. 664, 672 (1970).
This case pits a potential loss of Plaintiffs’ First Amendment freedoms against what amounts to
mere inconvenience to Defendants. It is in the public interest for the Court to guard against any chipping
away at Plaintiffs’ First Amendment freedoms, particularly where Plaintiffs have shown a strong likelihood
of success on the merits.
[emphasis added]
As such, for the aforementioned reasons, the Court will grant Plaintiffs’ Motion
for a Temporary Restraining Order [2]. Additionally, the Court will grant Plaintiffs’ Motion to Waive
Posting of Bond [3] and deny Defendants’ Motion to Dismiss Pursuant to 12(b)(1). An Order consistent
with this Opinion will follow.
May 5, 2005 /s/
Date Alexander Williams, Jr.
U.S. District Judge

FROM THE REVISED CURRICULUM:::

Myth: It isn’t “normal” to be homosexual or have homosexual feelings.

Facts: Alfred C. Kinsey’s landmark research beginning in the 1930’s and continuing into the 1950’s demonstrated that homosexual behavior occurs in this country much
more frequently than people had imagined ... It is interesting to note that only a few hundred years ago, being left-handed was considered the mark of a witch, a sign of perversity. The phobia of witchcraft was so pervasive that people were tormented, even murdered simply because they were lefthanded. Such a thing may seem unbelievable, but people can do very cruel things when they are afraid.

Future generations are likely to look back with equal astonishment that gay and lesbian people were subjected to similar acts of fear and hatred ... Very few of us have exclusively heterosexual or homosexual feelings throughout
our lives. Human sexuality is a continuum, not opposing “camps.” However, this culture has rigidly indoctrinated us that even the appearance of traits that are not assigned to a person’s gender role is cause for uneasiness ... People who overplay their cultural gender roles, who react negatively, or even cruelly to any deviation from these “roles”, may well be driven by a need to deny their own behavior or feelings.

[editorial note: this is in keeping with the homosexual normalizing propaganda which goes for the y/n statement of all people are homosexuals. Again no science just feeeeeeeelings. also note: author's statement that opposing homosexuality MAKES you a homosexual. Everyone is a homosexual and if you deny you are a homosexual that makes you a homosexual.]

Myth: Homosexuals are sick.

Facts: ... One’s sexual and emotional orientations are fixed at a very early age. Many experts claim at birth, certainly by age five ... Homosexuality was considered quite normal in Ancient Greece and Rome (both during their rise and decline in power), and in Native American Indian tribes where gays were elevated to very high leadership positions. Some present-day societies like The Netherlands have an accepting attitude, and in Denmark same-sex marriages are legal.

[added editorial note: Homosexuality was never considered normal in Greece, even Athens had the death penalty for those caught with boys and exile for those caught practicing sodomy with members of the same sex. The homosexualization of ancient history is brought by the same people who demand Abe Lincoln was a homosexual.]

Myth: Homosexuality is a sin.

Facts: The Bible contains six passages which condemn homosexual behavior. The Bible also contains numerous passages condemning heterosexual behavior.

Theologians and Biblical scholars continue to differ on many Biblical interpretations. They agree on one thing, however. Jesus said absolutely nothing at all about homosexuality. Among the many things deemed an abomination are adultery, incest, wearing clothing made from more than one kind of fiber, and earing shellfish, like shrimp and lobster. Religion has often been misused to justify hatred and oppression. Less than a half a century ago, Baptist churches (among others) in this country defended racial segregation on the basis that it was condoned by the Bible. Early Christians were not hostile to homosexuals. Intolerance became the dominant attitude only after the Twelfth Century. Today, many people no longer tolerate generalizations about homosexuality as pathology or sin. Few would condemn heterosexuality as
immoral — despite the high incidence of rape, incest, child abuse, adultery, family violence, promiscuity, and venereal disease among heterosexuals. Fortunately,
many within organized religions are beginning to address the homophobia of the church. The Nation Council of Churches of Christ, the Union of American Hebrew Congregations, the Unitarian Universalist Association, the Society of Friends (Quakers), and the Universal Fellowship of Metropolitan Community Churches support full civil rights for gay men and lesbians, as they do for everyone
else.

[added editorial note: having been around FR enough, it is VERY obvious this school curriculum totally lies and misrepresents Christian Church history, bible content, and ignores teachings of Christ. This is a PUBLIC school teaching a government established/mandated view of Christianity]

Myth: People “choose” to be gay or straight.

Facts: ... Most people feel that their sexual orientation is not a choice, it is a natural response for them. Trying to change one’s sexual response to straight or gay is usually unsuccessful. [note: totaly ignores sexual behavior in prisons.] We do have a choice regarding how we treat each other.

Hatred of gay men and lesbians is the work of humans, not God. As with any other group, the majority of gay men and lesbians are good people who are concerned about the future of our country and the world. They do no ask special
favors, simply the respect and rights that we all should enjoy, without fear of verbal or physical attacks ...

[editorial note: This is pure PFLAG, GLSEN, Lamda Legal, and HRC propaganda.]

I think this was a case of and egregious example of a state sponsored school establishing an exclusive monopoly state sanctioned docrine of acceptable christian believe.

IOW only THIS version of christianity is to be taught and tollerated.

I do think the judge did give the school board an out. The opinion allows for all views being taught as acceptable to not violate establishment clauses. HOWEVER, this does not adress the HUGE bovine manure regarding the misrepresentation of history and science.

It is as if they paid a buch of homosexual men and women to sit in a "gay" bar to write up a school sex curriculum for children.

This is a PUBLIC school teaching a government established/mandated view of Christianity

That's exactly what it is. Incredible that the school bureaucrats actually thought they could foist this off on people.

I can't even begin to imagine what it would be like to have an innocent child of mine in a government school. Thank God we can homeschool. Ours are safe.
