DETROIT (AP) — An attorney for filmmaker Michael Moore say the brother of Oklahoma City bombing conspirator Terry Nichols should be prosecuted for tax evasion.
In a deposition given in connection with his libel and defamation lawsuit against Moore, James Nichols said he doesn't file federal income tax returns, despite working as a farmer.
In a court filing, Moore lawyer Herschel Fink said he wants U.S. District Judge Paul Borman to "inform the U.S. Attorney's Office of Nichols' admitted, continuing tax evasion."
According to the deposition filed recently in U.S. District Court, Nichols told Moore's lawyers, "I'm not required to file."
Nichols, a soybean farmer from Decker in Sanilac County, sued Moore in October 2003, claiming the Davison native tricked him into appearing in the Oscar-winning 2002 documentary "Bowling for Columbine." Nichols also contends Moore libeled him in the film by linking him to the Oklahoma City bombing.
Borman is deciding whether to allow the suit to go to trial.
Nichols' brother, Terry Nichols, is serving two life sentences without parole for his role in the April 18, 1995 bombing that killed 168 people. Timothy McVeigh was executed for masterminding the bombing in 2001.
The Internal Revenue Service doesn't comment on taxpayers, said Stephen Moore, an agency spokesman in Detroit.
"Obviously if people are evading their taxes, there can be many different ways we would find out," he told The Detroit News for a Thursday story.
James Nichols' lawyers couldn't be reached for comment, the newspaper said.
Nichols' farm was raided two days after the bombing after Terry Nichols and McVeigh were identified as suspects. McVeigh had listed James Nichols' home as his address on some forms and said when he was arrested that Nichols was his next of kin.
So now Moore is going after private citizens who can't defend themselves against his millions?
