Yes, you are right. They would've keelhauled him and locked him away under Leavenworth or worse.
I heard one yarn on the ROC's that were based around DaNang. As the story went, there was so little enemy activity around Da Nang that the US gov't threatened to withdraw the combat pay of troops stationed there. Supposedly, the ROCs were told about this dastardly deed the gub'mint boys were about to do, so they went up on Marble Mountain and mortared the US base. The US troops kept their combat pay. I never had any contact with the ROCs but heard more than a few times that they were vicious yet effective fighters, that they were not to be messed with.

CIA counterterrorism director Cofer Black for final instructions. He said he was told: "'your basic marching orders are to link up with the Northern Alliance and get their cooperation militarily and they will take on the Taliban. "'When we break the Taliban, your job is to capture bin Laden, kill him and bring his head back in a box full of dry ice.'" This story was told a few years ago in Bob Woodward's book, "Bush at War" without the dry ice bit. (That could be an embelishment.) In Woodward's telling, bin Laden's head was to be delivered to the President on a platter.

Whether true or not, it sounds like a good idea to me. In fact, if the enemy feels like living in the 12th century, we should treat them as such.
