Two arrested in shootings

A day before deaths, one of the victims reported teens in neighbor's yard

DONALD -- The day before she and her husband were shot to death in their rural home, Becky Goode called 911 to report that three juveniles were in her neighbor's yard, possibly with plans to burglarize their house, and that one of them had fired a gun.

About 24 hours later, Gale Goode, 48, and Becky, 47, were found dead.

The Marion County Sheriff's Office on Friday arrested two teenagers in connection with the shootings and considers a third a person of interest.

Jorge Jimmy Ybarra, 19, was charged with felony murder and first-degree burglary and was booked at the Marion County jail about 7:30 a.m. Friday.

Emanuel Lopez-Delgado, 16, was charged with two counts of felony murder. After he was treated and released from Salem Hospital for a gunshot wound, he was taken to the Marion County Juvenile Department.

He then was booked into the jail at 2:17 p.m.

A third boy, 14, is considered a person of interest but has not been charged. He remains in stable condition with multiple gunshot wounds at Oregon Health & Science University.

Two other peoples in the house at the time of the shootings -- the Goodes' 4-year-old granddaughter and a woman in her 80s who is thought to be the mother or grandmother of one of the Goodes -- were not injured.

Someone in the house made the 911 call that the sheriff's office received at 3:24 p.m. Thursday, reporting gunshots at 20531 Matthieu Street NE in Donald.

About the same time as the gunshot report, a deputy spotted a silver Nissan Maxima in Donald and followed it on a hunch.

He stopped the car in the southbound lanes of Interstate 5 north of the Waconda Road overpass between Gervais and Keizer.

The three teenagers in the car were detained.

Deputy District Attorney Stephanie Tuttle said Friday that the DA's office would not release certain information because officials didn't want to do anything to jeopardize the investigation.

She declined to discuss neighborhood speculation about why the Goodes were shot and whether there was a shootout between the couple and the youths.

"Everything that I am able to tell you at this point is in this press release," Tuttle said.

Dispatch records showed that two calls from the neighborhood were made Wednesday, said sheriff's office spokesman Kevin Rau.

The first call was made at 8:48 a.m. by Effie Florea. She had returned to her home, next to the Goodes' house, and found an unlocked door that should have been locked. No suspects were in the house, Florea told dispatchers.

The second call, at 3 p.m. Wednesday, was the one made by Becky Goode.

Rau said that according to the dispatch report, Becky Goode said that she saw two juveniles climb over her neighbor's fence but that they couldn't get to the house because of a Doberman. At first she saw no weapons. She later saw a .22-caliber gun and a third juvenile.

Her husband went outside with a gun, she told a dispatcher. The suspects appeared to be leaving. She heard them fire a weapon but didn't know what at. Her husband was back in the house but was going to go back outside to check the area.

"It's not a giant leap," Rau said about the possibility that the earlier incident and the deaths the next day were related, but "I wouldn't go as far as to say they're connected."

Neighbors also said there had been recent burglaries in the area.

"All I know is someone was telling me that the people that shot them robbed them yesterday, and the lady that got shot saw their faces so they came back today to kill them," said Michael Pellissier, 23, of Donald on Thursday.

Neighbors said the Goodes were decent people who were quiet and kept to themselves.

The couple lived with their 4-year-old granddaughter, neighbors said. Court records show that they were appointed her guardians in 2002.

The child is staying with other relatives, Rau said.

The DA's office confirmed that the two people arrested for the shootings lived on Webb Avenue and Dover Avenue in northeast Salem. Their residences are in the same neighborhood.

Other residents said the third boy also lives in the neighborhood.

The sheriff's office expects him to be released from the hospital in two or three days.

If he is charged, his case would begin in juvenile court.

Measure 11 requires that youths age 15 to 17 who are charged with violent crimes automatically be waived from the juvenile system to the adult court system. Youths younger than 15 can be charged as adults but only after a process to waive them to adult court is completed.

"We know they were all involved in this, and it's just a matter of finding out exactly what happened," Rau said.

The charge of felony murder is a Measure 11 crime. With a conviction in adult court, it requires a sentence of life in prison with a minimum of 25 years.

The cases will be sent to a grand jury within five business days of the defendants' arraignment hearings.

Family members of Lopez-Delgado and Ybarra, reached at the homes where the teens lived, declined to comment.

Ybarra and Lopez-Delgado were students in the Salem-Keizer School District in the alternative Structured Learning Center, school district spokeswoman Mary Paulson said. They previously attended McNary High School, juvenile department spokesman Larry Oglesby said.

Ybarra and Lopez-Delgado were in school Thursday, Paulson said, but she did not know what time they got out of class.

Neighbors of the three teens expressed surprise about the news, but some said Ybarra, Lopez-Delgado and the 14-year-old had reputations for making trouble in their neighborhood.

"The only thing I know is they have caused a few problems," said Windy Iveans, who lives two houses away from where Ybarra lives.

"Just rattling up the other kids. Teasing and picking on them, causing fights, that kind of stuff," she said.

Teodoro Duran, another neighbor, said Ybarra seemed like "a good guy."

"I never heard that. That's why I'm so surprised. He was a real nice guy who went to school and came home," Duran said.

Baldo Pedroza, another neighbor, said that he never saw any of the three involved in violence but that at least one recently sprayed graffiti on a neighborhood church.

"I think they acted like they were gang members or something," Pedroza said.

Here is more detail on the Salem killing. We are starting to learn more about the killers. They were either bangers or wanna-bes. They were obviously near drop-outs as shown by the school they attended.

It is sad to loose good people to pond scum. A sad story, but I hope they all get convicted...either life or death.

Advice: Never go outside even if you have a gun, unless love ones are out there. Just my idea

from which one can conclude this was not their first contact with the juvenile "justice" system.

Professional criminals in the making. What kind of sentence will they get for murdering two people in cold blood? No more than a year or two, I'd venture to guess.

one of the initiations for membership into MS 13 is a random murder of an innocent civilian - since getting kicked out of El Salvador they've moved up to the US. very active in the Southern California region now

Fortunately, the wisdom of the US SC relied on international law to determine that juveniles shouldn't face the death penalty for crimes like this. Let's ask the Goodes daughter how she feels about it in about 25 years - right around the time that the 16 year-old and (maybe) the 14 year-old will be getting out of prison after their convictions for murdering her parents.

Since the article talks about the charges they'll face under Measure 11, and doesn't mention any diplomatic issues with Mexico, I assume they are legal citizens. There would be a whole lot of hoop-jumping-through if they were illegal aliens and we were going to charge them for this crime. I assume the newspaper is of the opinion that it is inherently racist to even question the immigration status of these guys.
