Ping for what will doubtless be a brief and passing moment of sanity in Florida.

And a class example of heavily biased "reporting."

Meanwhile, the ACLU sued the state of Ohio for issuing car licence plates reading 'choose life'. It claims this is discrimination because there are no pro-choice plates.

*****************

What would we do without the ACLU? Good grief.

You can't on the one hand say a girl of 13 isn't capable of making a choice to have sex yet at the same time allowing them to make life and death decisions.

>ACLU, said: 'This child has made a clear choice<

Hey idiot, 13 is NOT the age of majority in ANY state!

And by the way, who is being prosecuted for statutory rape?

Last time i checked there needs to be a sperm donor. And can we rule out the possibility that she was artificialy inseminated? Good.

So who and where is the SD???

And doesn't this "Dad" have a say in this urgent decision?

Is he a member of the DCF faculty??

This is the first report I've seen of a decision from the court. It seems contrary to the holding of North Florida Women's Health & Counseling v. State of Florida (FL, 2003).

Not only does a minor have a right to choose, it is against Florida common law, made at the highest level, to even require court permission for a minor to obtain an abortion. Further, it is against Florida common law to require a doctor to advise a parent of a minor's decision to have an abortion.

This is the first report I've seen of a decision from the court. It seems contrary to the holding of North Florida Women's Health & Counseling v. State of Florida (FL, 2003).

... but has had her wishes blocked by state officials who argue she lacks the maturity to make a decision.

The first page of the above case notes that under the unconstitutional law, a minor must notify a parent, or in the alternative, must convince a court that she is sufficiently mature to make the decision herself, or if immature, that the abortion nevertheless is in her best interests."

This case rendered that law unconstitutional. This case did not hinge on the question of "maturity," but it appears that maturity is an irrelevant point, since a minor is entitled to obtain an abortion without consulting a court, without consulting her parents, and with no obligation on the part of the clinic to inform the parents.

The case pits civil liberties groups against the religious right in clear echoes of the case of Terri Schiavo,

There are no "clear echoes". There would be "clear echoes" if she was forced to have an abortion against her wishes.

This is a signal that the Pro-Life movement has successfully integrated the legal tactics

This infuriates me. This child was raped. At 13 she cannot consent to sex. There is little chance that if she carries this child to term, she will allow it be adopted.

She will keep it because it's cute and now she has someone to love. How is that a good thing?

James Green, of the American Civil Liberties Union (ACLU), said: 'This child has made a clear choice; she has expressed it to the judge. There is no indication she is incompetent.

I agree...This kid made a choice...A choice that got her pregnant...That was a bad choice...And now, she's made another bad choice...Good on the judge...

Hey, the Supreme Court has ruled that even older minors can't be executed for murder because they weren't old enough to know what they were doing. That age cutoff of an otherwise legal option made exactly the same amount of legal sense as this age cutoff.

There is no indication she is incompetent.

Minors are never competent. That is why we call them minors.

Under Florida law, a 13-year-old can have an abortion without her parents knowing or agreeing. The legislature is considering a bill this session that would require parental notification, but not consent, for girls under the age of 16.

In 1988 and 1999, Florida tried to pass laws requiring minors to get their parents' permission to have an abortion. The Florida Supreme Court struck both down as unconstitutional.

The Department of Children and Families failed to even notify the court that she was gone so police could try to find her, Alvarez said.
