URGENT: Majority Leader Bill Frist IS GOING TO PULL THE TRIGGER to end the blockade against President Bush’s judicial nominees, but the outcome is still in doubt.
Dear Friend: In fact, high-level sources in the Senate are telling us that Majority Leader Frist will deploy the “Constituional Option” -- dubbed “nuclear” by the liberal media -- possibly within the NEXT FEW DAYS.
We’re winning Senators one-by-one -- getting them to see the necessity of using the Constitutional Option. But there are still seven Republican fence-sitters!

Liberals 'Going Nuclear'
Democrat Leader Harry Reid is threatening to shut down the Senate if Republicans move to end the filibusters against the President’s judicial nominees.
It would seem that the only ones "going nuclear" are the liberals in the Senate.
Since I wrote you last, the liberals have EXTENDED their reign of obstructionism by threatening to filibuster NON-JUDICIAL nominations -- including John Bolton's nomination as Ambassador to the United Nations and Lester Crawford's nomination as head of the Food and Drug Administration.
So what is Harry Reid's threat to "shut down" the Senate really all about?
If the Democrats can’t get their way, they don’t want the Senate to be able to do anything at all…
And it would appear that the ONLY way to stop these liberal "bullies" is to stand up to them and CALL THEIR BLUFF!
It's Not 'Nuclear,' It's 'Constitutional'
The liberals want you to believe the Constitutional Option is unconstitutional and a severe breach of Senate procedure.
Nothing could be further from the truth. The so-called "Nuclear Option" is not nuclear at all, it is based on democratic majority rule guaranteed by the Constitution. In fact, this “Constitutional Option” would simply restore more than 200 years of Senate precedent and end the partisan dirty tricks that now plague the judicial confirmation process.
The Constitutional Option is a simple procedure designed to stop the obstruction of President Bush’s judicial nominees and allow them finally to get up-or-down votes by the full Senate.
And as a procedural issue, the Constitutional Option is nowhere near as under-handed as the tactics the Kennedy-Daschle-Reid cabal have been using for the past four years to obstruct these judicial nominees.
The Liberals' Hypocrisy
Senator Ted Kennedy is the biggest defender of the Democrats' obstruction of President Bush's judicial nominees.
But what the often hypocritical Senator Kennedy neglected to mention is that he voted in 1995 and in 1975 IN FAVOR of a Nuclear Option and called the filibuster, "the shame of the Senate and the last resort of special interest groups."
Senator Robert Byrd also took to the Senate floor recently to rail against the Constitutional Option.
But -- just like Kennedy -- Byrd failed to mention that he led the charge in the Senate to stop filibuster tactics in 1977, 1979, 1980 and again in 1987.
You see...one thing that is not really being mentioned in this debate is that the “Nuclear Option” is NOT A NEW IDEA.
In fact, Senate Democrats tried for years to implement the Nuclear Option REPEATEDLY -- when they held the majority.
What HYPOCRISY!
The Battle of the Century
This battle is too important to lose. We really need to ramp up our efforts to counter the Left’s multi-million dollar, all-hands-on-deck campaign to defeat the Constitutional Option and President Bush’s judicial nominees!
And this fight is only getting bigger. Don’t forget the liberals are threatening to expand the filibusters, and at least one Supreme Court vacancy is going to open up soon -- maybe two, three or even four. Chief Justice Rehnquist is ill, and Justices Stevens, O'Connor and Ginsburg are all over 70 years old.
Our ability to place a real conservative majority on the Supreme Court may very well rest with this Constitutional Option.
If we fail now -- an entire generation will pass before conservatives have another opportunity to put common sense judges on the bench.
The vote on the Constitution Option will happen in days, but there are still Republican Senators waffling. We must counter the Left’s campaign and let the fence-sitters know that we expect them to do the right thing.
This is literally the battle of a lifetime.

I'm all for ending the filibuster, but let's at least call a spade a spade: we've been calling this the nuclear option for months; the MSM didn't invent that one.

I'm not sure if a democrat or a republican first called it going nuclear, but it was at least 2 years ago.
I do know that the Republicans did not object to that languarge early in the debate.
Due to the ideological battle, it is now necessary to emphasize the truth...that what is being proposed is entirely constitutional.
Senators are permitted to change Senate rules according to the Constitution. It specifically says they are allowed to do tht.

The President has the RIGHT to select his choices to reside on the Courts. I didn't elect a Maverick. i didn't elect a Liberal. We elected George W. Bush so it's time they shaped up and supported his nominees.
