HEBBRONVILLE, Texas - It will be at least five years before Casey Nethercott can get his civil liberties restored.
As of Monday, he was a guest of the Texas prison system, starting a five-year sentence for being a convicted felon in possession of a firearm, said Rudy Gutierrez, an assistant district attorney in Jim Hogg County.
Nethercott will not be returning to Arizona in the near future and will not have his civil rights restored "anytime soon," Gutierrez said.
The man, once connected with Ranch Rescue, an organization that was formed to stop illegal immigrants from crossing the U.S.-Mexican border, came to Arizona to help people in the state fight against what he has termed an invasion.
During his time with Ranch Rescue, Nethercott, who settled in the Douglas area, got into trouble in Texas. Nethercott severed his relations with Ranch Rescue and started his own organization called the Arizona Militia.
He was initially charged with being a felon in possession of a firearm and aggravated assault against two illegal immigrants from El Salvador.
Convicted of the weapon's charge, a Texas jury was hung on the aggravated assault charge, Gutierrez said.
While Nethercott and his attorney said they planned to appeal the one conviction, nothing was ever filed "and we wouldn't agree to an extension," Gutierrez said.
Nethercott returned to Texas for the new trial concerning the aggravated assault charge. When he appeared in court on Monday, the judge ordered him to be taken into custody to start his jail sentence, Gutierrez said.
Because of the judge's action and other issues, the aggravated assault charge was dismissed this week, he said, adding the two victims were satisfied.
Attorneys for the victims have filed a civil suit against Nethercott and others to apparently go after the $60,000 cash bond Nethercott posted for his appeal that was never done and to remain free pending a new trial on the aggravated assault charges, Gutierrez said.
Nethercott was a convicted felon in California on two charges, which is why the charge of being a convicted felon in possession of a firearm was made in Texas, the assistant district attorney said.
In March, Nethercott told the Sierra Vista Herald/Bisbee Daily Review he intended to have his civil rights restored so he could once again carry a firearm. He also said he intended to run for sheriff of Cochise County.
During that interview, Nethercott railed against the Minuteman Project, saying it was infiltrated by neo-Nazis.
He said he was looking at purchasing two helicopters for his militia, whose strength is unknown, and other weapons once his civil rights were restored.
While he said he was going to file for rights restoration in Cochise County, no court records have been found indicating that has happened.
While in Arizona, Nethercott came up against the federal government and was accused of three counts of threatening to intimidate and murder U.S. Border Patrol agents.
After spending more than six months in federal incarceration, Nethercott was found not guilty of the three charges by a Tucson-based federal jury.
Gutierrez said Nethercott likes publicity and seeks it out. But Monday, he was unusually quiet when taken into custody, Guiterrez said.
This one was a serious goofball. Ironically, it was his group that had White racist connections.

Isn't it more likely than not that immigration activists are naturally going to attrack some people who dislike immigrants for the wrong reasons?
Or, maybe "W" simply confused the different groups. Remember, when you are busy running the White House you can't know everything, or even begin to sort out the different groups going after the same problem with varying motives.

You know, that seems entirely possible. Perhaps wishful thinking on my part. I would really like to see W come out and support the MMP, or at least the idea behind it. I haven't heard of this Nethercutt guy but I would distance myself from him as well.
