Voter-approved spending limit all but eliminated

OLYMPIA—Governor Christine Gregoire signed SB 6078 today, amending the voter-approved I-601 spending limit. The bill removes the 2/3 vote requirement for the legislature to raise taxes during the 2005-07 biennium and redefines the spending limit growth factor to allow state spending to grow at a faster pace than previously authorized.

The House passed SB 6078 on April 15, the same day federal income taxes were due. The Senate approved the bill on April 16. Today’s bill signing was required for Democrats to be able to raise taxes with a simple majority vote.

“Today Democrats made it clear that a 12 percent increase in spending is not enough to satisfy their constituents’ thirst for our money,” said Bob Williams, president of the Evergreen Freedom Foundation. “How ironic that on the same day we were paying our taxes, Democrats made it easier to raise taxes even higher.”

“Make no mistake, with this bill the state no longer has a meaningful spending limit,” said Williams. “It is now open season on the wallets of Washingtonians.”

Odd. I thought based upon what the Dems have been saying about approving judicial nominations that 2/3 of a majority was a good thing, a simple majority a bad thing. Now they've gone and supported the simple majority.

It's very confusing trying to keep all this straight.

As long as you're rolling in dough, how about sending a couple of billion down to California? We need to keep up our interest payments on our state budget deficit bonds. Things are great when the Dems control everything.

If the election were declared void..anything she signed wouldn't be illegal..it would be a "non-event"..

FYI..FWIW.the FDems will drag it ou tas long as possible, and the Wash St SC ..all Dems..will never overturn the election..however..keeping it in the public eye is a good thing for the GOP..I think it will cost Cantwell her seat in 2006...The voters will take it out on her..

Michigan ranked dead last in creating new jobs in 2004, losing 45,000, and is near the bottom in income growth, reports the Wall Street Journal.

Our socialist loving governor, Jennifer Granholm, is pressing ahead with a European style tax boondoggle that will heap huge tax breaks on the big three automakers, while passing extra taxes onto retailers, professional services, wholesalers and thousands of small businesses.

Granholm, who’s punished the state with the nation’s highest unemployment rate, is following the playbook of European socialist leaders by picking tax winners and losers.

The state has the highest corporate tax burden in the nation, said the Tax Foundation. And in spite of the high taxes, Michigan lost tax revenue in 2004, only one or two states to do so.

Meanwhile, Granholm goes ever onward with her $100 million “cool cities’ mischief, picking winners and losers for gerbil lofts, vegetable markets and hot dog stands.

The DEM's put an emergency clause on the bill so it can't be challenged by the voters. To change the law a whole new initiative will have to be filed and run next year.

What does Washington's constitution have to say about the legislature and governor overriding an initiative once its been passed by the voters?

Of course, I'm presuming that the 'I' in front of the number indicates that it's an initiative. Do I have that right?

If the election is voided, all acts taken by the governor, including the signing of bills, are void. If the election is void, all acts resulting are also void. It will be as if Gregoire was never the governor in the first place.

In a way, it is very similar to the gay marriage mess in Oregon. The Oregon supreme court ruled that the 3,000 or so homosexual marriages were void ab initio; as if they never happened. The same thing applies to all bill signed by Gregoire. To think the state supreme court would rule otherwise is unsupportable.

Does she think she has a mandate? Every single time a democrat gets elected governor or president, the first thing they do is raise taxes. Count on it. They do this right away so it has time to be forgotten before the next election. If you want a tax increase right away, vote big D.

the only reason the Democrats are being so brazen about this is because the know the vote for governor is going to be tossed aside and Gregoire would have no chance of winning a revote. They will then argue that legislation signed into law by Gregoire is still valid. That will not be the case. The Democrats are desperate and despite their words, they know they will lose the election contest.

Washington law does not allow the voters to change the Constitution with an initiative (only the legislature can initiate constitutional changes). That means that the legislature can change a law the people pass with a 2/3 vote within 2 years of its passage and with a simple majority vote after 2 years. For example, I-601 required a 2/3 vote to raise taxes but since it passed in 1993, the legislature was now able with a simple majority vote to eliminate the 2/3 vote requirement to raise taxes. Convenient isn't it?

James Taranto mentioned on Best of the Web that the Dem controlled state legislature was in keeping with the national DNC's stand on the filibuster when they amended the voter required super majority rule for raising taxes - they are both anti-democracy.

It seems to me that having the initiative process designed like that makes it virtually useless. Why bother even having an iniative process when any of them can be nullified so easily?
