DCF: Terri Schiavo Not Abused, Exploited

State Agency: Terri Schiavo Was Not Abused or Exploited by Either Side of Her Family

Apr. 16, 2005 - State investigators found no evidence that Terri Schiavo had been abused or exploited by either side of her family, according to documents released by Florida's Department of Children and Families.

The agency investigated 89 complaints dating back to 2001, when Schiavo's feeding tube was removed for the first time and the legal battle surrounding her right-to-die case intensified.

The calls alleged that the brain-damaged woman was being mistreated by her husband and her parents for financial gain. One complaint alleged that Schiavo's parents were selling videos of her through a Web site; another said Schiavo's husband wasn't spending money intended for her rehabilitation.

But investigators said they found no evidence that either her husband or parents were exploiting her, and often noted in their records that they found Schiavo well cared for on their visits to her Pinellas Park hospice.

The agency released the records Friday under court order.

Schiavo, 41, died last month after her feeding tube was removed for the third time, ending a bitter court battle between her husband, Michael Schiavo, and parents, Robert and Mary Schindler, over whether she would have wanted to live in a vegetative state.

The repeated allegations of abuse were based partly on bone scans showing Terri Schiavo suffered fractures and statements she made to family and friends that she was unhappy in her marriage.

Schiavo's husband has denied harming his wife. His lawyer said the fractures resulted from osteoporosis caused by the woman's years of immobility and complications of her medication.

Robert Schindler declined to comment there on the release of the DCF documents. An attorney for Michael Schiavo did not immediately return calls.

Who's paying for Terri Schiavo's care?

Taxpayers -- and a St. Petersburg area hospice, which provides daily care for free.

Money that Schiavo's husband, Michael, received as part of a medical malpractice lawsuit in his wife's case in 1993 is almost gone, said Deborah Bushnell, one of Michael Schiavo's lawyers. Of the $700,000 payment, only about $50,000 is left, Bushnell said. The rest went to pay for medical care for Schiavo, who has been in a persistent vegetative state for 15 years, and for legal fees in the battle over her fate, she said.

Medicaid, the state and federal program that pays medical costs for the poor and indigent, has been picking up the tab for Schiavo's medications for two years, Bushnell said, while the hospice provides care for free.

Louise Cleary, spokeswoman for Woodside Hospice, the 72-bed center where Terri Schiavo has been in Pinellas Park, said she could not discuss Schiavo's case, but the average cost of care is about $80,000 a year. ''We are a not-for-profit hospice,'' Cleary said. Although most patients have private insurance or state or federal coverage for the medically indigent, some don't have coverage. ''We never turn a patient away who needs us. Never,'' Cleary said.

With the money in the fund nearly exhausted, Bushnell said neither she nor attorney George Felos have been paid in more than two years. Throughout the case, she said, she has been paid a total of $80,309 and Felos $358,434. A judge approves all legal costs, she said, adding that Michael Schiavo does not have control over the guardianship fund.

Well! No condescension there. Hey, wizeazz, didn't I not ask you for a source?

The facts seem to matter little to those who would have insisted on torturing her by force feeding her for however long they could have kept her breathing.

If Terri was like a "houseplant" -- as Felos is widely quoted as having likened her -- it wouldn't be "torture," would it? And you have left untouched my point about the fact that Michael was ignoring Terri's wishes himself for years on end -- years that ended, of course, after the money came in. That fact is undeniable, even if you are on Michael's side.

I have read most of Wolfson's report (which should have had footnotes so we could read his references ourselves and not be held hostage to HIS prejudices, some of which can be read below), and the part that addresses amputation reads as follows:

Throughout the course of the litigation, deposition and trial testimony by members of the Schindler family voiced the disturbing belief that they would keep Theresa alive at any and all costs. Nearly gruesome examples were given, eliciting agreement by family members that in the event Theresa should contract diabetes and subsequent gangrene in each of her limbs, they would agree to amputate each limb, and would then, were she to be diagnosed with heart disease, perform open heart surgery. There was additional, difficult testimony that appeared to establish that despite the sad and undesirable condition of Theresa, the parents still derived joy from having her alive, even if Theresa might not be at all aware of her environment given the persistent vegetative state. Within the testimony, as part of the hypotheticals presented, Schindler family members stated that even if Theresa had told them of her intention to have artificial nutrition withdrawn, they would not do it. Throughout this painful and difficult trial, the family acknowledged that Theresa was in a diagnosed persistent vegetative state.

Who was it that "elicited agreement" regarding the hypothetical situations? Obviously, that would be an advocate of Michael Schiavo's, wouldn't it? So Michael's attorney -- be it Felos or whomever -- asked the Schindlers essentially at what point they were willing to give up, and were offered a laundry list of scenarios that would make them agree to leave their daughter to die.

Like I said, it would have been helpful if Wolfson had provided a searchable reference to a court document that would explicitly show what questions were asked to "elicit agreement," especially since he non-objectively referred to the Schindlers' response as "disturbing." Unfortunately, absent that, we have to go to more convenient sources, like Terrisfight.org, whom, to my knowledge, hasn't been accused of creating court documents from whole cloth.

Wolfson did, however, note that when Schiavo asked Terri's urinary infection not to be treated, it was hospital administration that refused him -- not the Schindlers' action, as said before, since Schiavo was, at this point, keeping the Schindlers in the dark regarding Terri's condition and medical records.

Guess what - you NEVER know what evil lurks in the minds of men. So you should not be so sure of what you have next to you. More so, since you say - it's was Terri's fault and she is to blame for her own death because of her choice. What you are sowing on Terri's behalf is not nice - but what you sow you reap. Our words mean something and we are responsible for them - not wise to make that statement concerning Terri - if you don't want that statement to be your eulogy someday.

If you can name one key player in the Terri Shiavo case who wasn't on the board of Terri's hospice, isn't connected to or a member of the Hemlcok Society, or recieved enormous campaign contributions from Michael Shiavo's attorneys, I will abandon my "conspiracy theory" here and now, and I will accept, without question, the "summaries" of DCF reports Judge Greer so generously made public.

(Oh wait a second, there WAS a GAL who did not have any ties to the Hemlock Society, the board of hospice, nor had he made any campaign contributions to Judge Greer! He ruled in favor of the parents, and against Michael Shiavo. And, of course, the Honorable Judge Greer abrubtly disregarded and discounted the GAL report as "bias". (Talk about the pot calling the kettle black.)

The Hapless Misadventures of the Pinellas County Court System keeps getting stinkier and stinkier and scarier and scarier. Michael Schiavo’s attorney George Felos took his case and then filed the petition to introduce HB 2131 in 1999. Then the law in Tallahassee gets changed. Then the Schiavo case gets heard. In that order.

In April 1999 - House Bill 2131 was introduced in the Florida legislature by the Florida Elder Affairs & Long-Term Care Committee to amend Section 765 (Civil Rights) of the Florida Statutes. The amendments to Section 765.101 were the legal definition of “life prolonging procedures” to add: “INCLUDING ARTIFICIALLY PROVIDED SUSTENENCE AND HYDRATION, WHICH SUSTAINS, RESTORES, OR SUPPLANTS A SPONTANEOUS VITAL FUNCTION”. It becomes law on October 1, 1999.

Who lobbied for changing the law to make food and water be defined as “artificial” life support in 1999?

Note that the hospice where Terri Schiavo has been held is operated by Suncoast Hospice. Rep. Gus Michael Bilirakis lists himself on the Suncoast Hospice Board of Directors - along with George Felos who filed the suit in the summer of 1998 to withdraw food and water form Terri Schiavo. Who else has also been on that Board?

Side Note: George Felos, Michael Schiavo’s attorney, was a nine year member of the Hospice of the Florida Suncoast which operates Woodside Hospice where Terri Schiavo is housed. He was also a former chairman of that board. Felos resigned in 2002. Terri was moved to the Woodside facility in April of 2001 from a nursing home even though she didn’t qualify as a terminally ill patient and technically should not have been transferred. And to complicate matters further, medical records from Terri’s hospital admission in 1991 indicate there was trauma to her head and no evidence of any heart problems or other diseases. Side Note: Mary Laybak, CEO of Woodside Hospice has direct ties to Euthanasia Society of America and Hemlock for Hospice, an organization that seeks to accelerate the dying process. Federal funds may not be used for these purposes.
The Hospice is a federally funded program designed for terminally ill and those whose death is eminent. Terri has been in Woodside Hospice illegally for three years under Medicaid payments, for free, courtesy of, yep, George Felos. Felos combined and conspired with Michael Schiavo to arrange for Terri’s “free” stay at Hospice Woodside as part of an “exit protocol” designed to advance Felos’ self-perceived messianic mission of “helping” incapacitated people to die by categorizing them as “terminal,” warehousing them, and depriving them of therapy and rehabilitation services.

US Dept of Health and Human Services is currently trying to collect $14.8 million from Florida Suncoast Hospice, owed to them since 1997. The squeaki-clean(not) Hospice is accused of patient brokering and several lawsuits filed by Attorney Jonathan Alpert are pending.

Our fine judge accepted as the basis of his rulings, the questionable testimony of Michael Schiavo that Terri would wish to be killed, yet Michael never stated this until after he had received the 1.2 million dollar settlement during which time he portrayed himself as a loving husband that just wanted to bring his wife home and take care of her.

The judge also accepted as the basis of his rulings, the “opinion” of a third doctor who is the brother of a close associate of George Felos, Michael Schiavo’s right-to-kill attorney, and very significantly, former Chairman of, you got it again, the same hospice board, Hospice of the Florida Suncoast, which operates Woodside Hospice in Pinellas Park, Florida.

And that will not be the end of it. Other actions are forthcoming through the courts. These other actions have not been reported anywhere and will detail violations of law at the hospice which will shock even the hospice's own staff. The board of directors needs to act to protect the hospice from those in administration who have led this hospice astray and betrayed the hospice mission. The board of directors needs to act soon to prevent further damage by those who only wish to cover up their wrongdoing, intimidating any who voice opposition to their wrongheaded and illegal activities.

This amended complaint names two of the class of plaintiffs suing the hospice: Roylee Miller and Judy Reeves, and all others who have been harmed or damaged by the actions of the defendants.


The original case number in the Pinellas County Circuit Court is: 03-1620-CI-20

The following Exhibits are attachments to the lawsuit filed against Hospice of the Florida $uncoast in the Pinellas County Circuit Court. They are now part of the public record and may be shared freely with others. These documents are internal hospice financial statements and minutes from board meetings of the nonprofit foundation that gives funds to the hospice, from the board meetings of the nonprofit hospice itself, minutes from the for-profit subsidiary and various financial statements.

Final determination of the actual implications of these documents and the lawsuit's allegations will be and must be determined in a court of law. However, they are extremely relevant, and you are invited to come to your own conclusions for your own opinion on this matter.

Note: The For-Profit subsidiary of Hospice of the Florida $uncoast is a hospice data management software company. "Hospice Systems, Inc." is the for-profit software company that does business as "Suncoast Solutions." This for-profit subsidiary has financial statements shown below.

We have been unable to locate a record in the financial statements of the for-profit showing a loan as a liability to be repaid with interest to the nonprofit hospice. That doesn't mean it doesn't exist; it just means we haven't been able to find it. If any record of such is discovered, we will post it, but nobody has shown us such a document. What is interesting to note is that amounts similar to what is said to be a "loan" in the minutes of the nonprofit hospice show up in the financials of the for-profit subsidiary as stock in the for-profit. We have not yet been able to determine who owns this stock (perhaps the hospice?), and we expect that that data will come out later in the court proceedings.

However, we have not been able to find the "loan" to the for-profit showing as a liability on HSI's financials and listed as a "loan" with interest payments to be paid by HSI d/b/a $uncoast Solutions. As the legal "discovery" process unfolds, we suspect that further documentation will be revealed providing greater insight into the financial transactions.

In fact, "payback to Hospice" has not yet begun as the software company continues to experience issues and problems in its software, finances, development and expenses." - from the lawsuit.

"Suncoast Solutions has also released confidential patient information without authorization." - from the lawsuit. Although the memo states that the confidential information will be removed immediately IN 2001, this hospice "money-making" venture never did that; we at Hospice Patients Alliance know they did not since Hospice Patients Alliance has confirmed the confidential information is still there as of March, 2003 TWO YEARS LATER!! ... and was freely available to the public and all hospices who purchased the software from the hospice for-profit venture!

Good post! Plus the fact - they are too irresponsible to even want to believe the fact - they will reap what they sow.

They can be haughty all they want and they play around here for a few minutes - and walk off self-satisfied with their sarcasm and made up facts to fill their own needs but NEVER give a thought to what they said.

That concept cannot be fully understood and how it applies to each and every one of us UNTIL one wants truth. But the fact is even if one doesn't want to believe it - it happens anyway. We are all responsible for what we allow to come out of our mouths. It's a universal - nothing can stop it.

It was no big deal what MS did to Terri - hey if that's what they live by , so be it. And the quote 'it's the law', etc, etc. Or it was her fault because she married him. All along forgetting what they embrace they have.
Terri is bedridden and someone here says - she should get up and get herself some food. Nice, huh? And they believe no consequences will ever come to them by what they embrace and feel safe behind the screen. There is no hiding.

Hmmmm. I had unexplained low potassium when I went to the ER several years ago. Had to be given a horsepill of potassium every hour to get it back up to normal. I can assure you the only eating disorder I have is that I like to eat too well, and I don't get rid of it by puking it up. It all goes on my hips. Low potassium does not always just naturally label the person "bulimic" or "anorexic", but poor Terri got labeled anything Mikey wanted to stick on her. We HAVE to believe him, since she couldn't talk for herself I suppose. Apparently, Judge Greer took a liking to Mikey and his every word was gospel from there on out.
