Sounds like an assault with a deadly weapon to me. Idratherbe should have opened fire once she realized she was being assaulted.

I agree. When it became obvious that she was under direct assault, she should have dropped the phone and opened fire. She's lucky to be alive - remember that the cops are, at best, a cleanup squad.
