Court tosses conviction of man who endorsed Bush's death

Mailing a letter to the White House supporting President Bush's death at the hands of terrorists is not illegal, a federal appeals court ruled Friday.

The decision overturns the conviction and 18-month sentence given last year to an Oregon inmate who sent a rambling, poorly written letter to the president. It read, in part, "You will die too George W Bush real Soon they Promised That you would Long Live Bin Laden."

I knew an inmate at Kansas State Pen in the segregation unit that was nuts and frequently wrote threats to president carter and other dignataries saying he was Col. Chastain of the freedom fighters of america. He was ex-military but nuts and had been on lockdown for several years. He said that when the president came to Kansas City for a scheduled visit his group was going to have him killed. Three days after the letter went out 2 secret service agents showed up and talked to him for 7 hours. He said later he would never write another letter. When the state of Kansas released him he went to Danbury Conn. federal correctional institution for 3 years for the threat.

I guess this Judge doesn`t know the law. As Clint Eastwood would say from "In the line of fire"...

"Ah now you shouldn`t have gone and said that. Threatening the President is a Federal offense. You can go to jail, even if you don`t mean it."

9th Circus?

What else? (I ask rhetorically). Why doesn't Congress simply abolish the 9th circuit completely? I dont see why, say, Montana- the 9th curcuit- couldnt handle all their appeals. That should do 'em.

But...then again...if Kerry had been elected President, who would have sent the letter? The terrorists and the left would have gotten what they wanted...nobody would have been threatening death to the president then!

Yes. I don't think expressing a wish that the president die at the hands of others is a criminal offense.

Mathew Hale got 40 years in the slammer. And he didn't do anything to any judge. He didn't directly threaten any judge from what I understand. I want court reform

If he didn't threaten the judge, he should not be in jail for it.

Judging from his resume, I think Hale would have ended up in jail eventually. He is a pretty despicable bottom-feeding low-life. But I read that he did threaten the judge, and admitted it. What's the real story here? We should wait until he commits the crime he most certainly was headed for, THEN throw the book at him.

Thanks, I knew something bothered me about that post. I don't think Mathew Hale should be a poster boy for our fight against judicial tyranny. He is unsavory.

Hale is a jerk and a poor specimen of a human being I agree. But I just think the punishment should fit the crime. I think 40 years is excessive.

You have a good point. But because he is dangerous and possibly deranged, from my perspective anyway, I am unable to summon up any outrage about the excessive sentence. It's probably a good thing I am not a part of the judicial system.
