No, not quite.

Judges are only "activist" if they Ignore the facts, Ignore the law, or by fiat, write their own law.

And.. congress can, at any time, disband any court, or "reform it" entirely, except for SCOTUS.

Thank you, xcamel. Thank you so much for making a point that far too many people tend to forget. Congress, as representatives of the people, have final authority. That is the essence of Republican government.

Really? Wouldn't it be great to see about 12 courts in Florida shut down? Just for starters.....

I still believe that everyone is missing one of the nastier subtexts of this case. I think Felos and Greer hometowned the opposition. It was a wink and a nod and greer gave the lawyer he knew what he wanted for his client. Once the "facts were established" then the appelate courts had nothing to do but affirm. When Jeb Bush signe FL's terri's law, Greer was basically going to always affirm his prior finding.

There has to be a way to reform the judiciary to deal with cronnyism as much as a judge who ignores the law.

BTW sometimes a person becomes a judge more for peter principle rather than competence. Being a judge in FL have very little to do with actual legal knowledge compared to POLITICAL knowledge.

I don't think that's correct about SCOTUS - because the Constitution does not specify the court - and according to Mark Levin's book, "Men in Black" - the Congress can IMPEACH even a SCOTUS judge for misusing "good behavior".

It's time - maybe way past time - to start stepping on these people for these TOTALLY UNCONSTITUTIONAL rulings. And .. those rulings can be considered contrary to "good behavior". By ruling against the Constitution [which they swore to uphold] - the judges have committed BAD behavior.

THESE PEOPLE ARE APPOINTED - NOT ELECTED - AND MUST THEREFORE BE ACCOUNTABLE TO THE PEOPLE THROUGH THE CONGRESS.

OUR JOB: Contact our congress people and compel them to reign in these out of control judges. Yep! The dems are gonna scream. But the screamers don't have much credibility any more.

We must not allow our congress people to shrink back simply from what some idiot dem says - that's just not reasonable - remind them THE DEMS DIDN'T ELECT YOU - WE ELECTED YOU - AND WE CAN UN-ELECT YOU IF YOU REFUSE TO DO YOUR JOB. Be tough!! The times call for it.
