If that's the case, then why did MS petition the court for an order declaring Terri could only receive communion twice (and stipulate WHO could give it to her), for permission to retain custody of Terri's body after her court ordered death and permission to have her cremated? Butt-covering, basically - if he's got an order in hand, then any challenge from her family is DOA.

And where does the right to guardianship enter into this new scheme you're developing?

I used to think some of them were untouchables also, but I think that has changed. Hopefully they will stay in the smoky backroom! I certainly hope you're right. I avoid most of them. They don't debate, they humiliate and cut down anyone who disagrees with them. They are armed with one line zingers they throw like daggers.

And where does the right to guardianship enter into this new scheme you're developing?What the heck are you talking about? She did have a guardian. He was in dispute, but he filled the bill as far as the law was concerned and was not a battling "they".

God gives us free will and we are judged on the use of that free will.
How easy to ignore "Thou Shalt Not Kill"
So easy to ignore...........
Matt. 25:41-45
"Then he will say to those on his left, 'Depart from me, you who are cursed, into the eternal fire prepared for the devil and his angels.
For I was hungry and you gave me nothing to eat, I was thirsty and you gave me nothing to drink,
I was a stranger and you did not invite me in, I needed clothes and you did not clothe me, I was sick and in prison and you did not look after me.'
They also will answer, 'Lord, when did we see you hungry or thirsty or a stranger or needing clothes or sick or in prison, and did not help you?'
"He will reply, 'I tell you the truth, whatever you did not do for one of the least of these, you did not do for me.'

What's the guardian supposed to do with respect to our new requirement for perpetual counsel? Or are we proposing that all incapacitated persons get permanent counsel who will act as their legal guardians as well?

What's the guardian supposed to do with respect to our new requirement for perpetual counsel? He does things outside the court. What is so hard about that? I am my blind and mentally handicapped daughter's guardian. I attended special ed meetings. I attend her group home meetings. They call me whenever she has problems at work. I am not her attorney.

LOLOL..It's called the Smokey Backroom. It's here on FR. It's on the list to the right of the screen 'browse by forum'. The 7th one on the list.
To: AndrewC
And when the legal guardian and the permanent counsel disagree about the proper course of action for the incapacitated person, what then?

you die!" Well.......

Well, he will die sooner or later and when he does he will face God and answer to him. My guess is he will be going to hell quickly!

765.105 Review of surrogate or proxy's decision.--The patient's family, the health care facility, or the attending physician, or any other interested person who may reasonably be expected to be directly affected by the surrogate or proxy's decision concerning any health care decision may seek expedited judicial intervention pursuant to rule 5.900 of the Florida Probate Rules, if that person believes:
(1) The surrogate or proxy's decision is not in accord with the patient's known desires or the provisions of this chapter;
(2) The advance directive is ambiguous, or the patient has changed his or her mind after execution of the advance directive;
(3) The surrogate or proxy was improperly designated or appointed, or the designation of the surrogate is no longer effective or has been revoked;
(4) The surrogate or proxy has failed to discharge duties, or incapacity or illness renders the surrogate or proxy incapable of discharging duties;
(5) The surrogate or proxy has abused powers; or
(6) The patient has sufficient capacity to make his or her own health care decisions.

LOL. Well, then, I guess you'd better explain how your Probate Attorney's Full Employment Act will create an "interested person who may reasonably be expected to be directly affected by the surrogate or proxy's decision". And assuming we get through those rapids, we can then contemplate the practical day-to-day effects of the scheme you're proposing. Basically, every incapacitated person automatically gets a court-appointed attorney, which, of course, the state will have to fund. Then, even better, that court-appointed attorney, a complete stranger to the family, now has effective veto power over the legal guardian by virtue of the fact that they're empowered to tie the guardian up in court from now until the end of time. Well, hell - why didn't you just say so? That's just the sort of intrusion that people will welcome with open arms, I'm sure. LOL. I think you should write your congressman and your state rep with that plan, and see if they don't drop it like a hot rock.
