Per Sekulow on Sean's radion show, maybe Fridayish, an actual DE NOVO would actually take 2-3 months, so to me, the reinsertion would be a no-brainer. Perhaps that's why it didn't occur to the Senate to specify that.

Perhaps that's why it didn't occur to the Senate to specify that. That's exactly it. I heard one of the Senators (for the life of me I can't remember which one), and he said exactly that - that in order to get a de novo review they would HAVE to reinsert it. But there was something about the language or SOMETHING, so they left it out since it was so "duh."

I think (but am not certain) Sensenbrenner's Bill did specify it.
But it shouldn't need to be specified. Obviously, it would be pointless, at least from the standpoint of possibly saving Terri's life, to have a DENOVO hearing without the reinsertion of the feeding tube, as Terri would expire before it was completed. I truly don't understand why there would be genuine disagreement by the judges on that issue.
