Yes it would be illegal. Jeb did the right thing. Only a higher court can overrule a lower court. If a judge acts improperly, he can be removed from office: impeachment for federal judges, the ballot box for local judges.

From a practical matter, if he did use force to seize and rescue Terri, such a move would be broadly popular. The psychology of the American people is such that they admire the BOLD leader, even if he acts a bit outside the law, that the timid, legalistic, Carteresque leader. This explains why individuals like Jesse James are still admired in the US after all these years. The popularity of such a move would immunize Jeb from any legal repercussions or danger of losing his job.
