Question: A lot of people have been calling for Jeb Bush to do more for Teri, to maybe send the National Guard in or something. Can he do that? This wouldn't be illegal? I assumed that if this violated the judge's order, the guardsmen could refuse it. Is there anything else Jeb could do?

Yes it would be illegal. Jeb did the right thing. Only a higher court can overrule a lower court. If a judge acts improperly, he can be removed from office: impeachment for federal judges, the ballot box for local judges.

Jeb did the right thing. It's separation of powers. People calling for executive action in this case are misguided. It's not the American way.

Legality and illegality can be abstract concepts. Jeb Bush, I am sure, has legal counsel able to justifiy virtually any action, no matter how threadbare such justification could be. From a practical matter, if he did use force to seize and rescue Terri, such a move would be broadly popular. The psychology of the American people is such that they admire the BOLD leader, even if he acts a bit outside the law, that the timid, legalistic, Carteresque leader. This explains why individuals like Jesse James are still admired in the US after all these years. The popularity of such a move would immunize Jeb from any legal repercussions or danger of losing his job.
