Hours after a judge ordered that Terri Schiavo was not to be removed from her hospice, a team of state agents were en route to seize her and have her feeding tube reinserted -- but they stopped short when local police told them they would enforce the judge's order, The Herald has learned.
Agents of the Florida Department of Law Enforcement told police in Pinellas Park, the small town where Schiavo lies at Hospice Woodside, on Thursday that they were on the way to take her to a hospital to resume her feeding.
For a brief period, local police, who have officers at the hospice to keep protesters out, prepared for what sources called ``a showdown.''
In the end, the squad from the FDLE and the Department of Children & Families backed down, apparently concerned about confronting local police outside the hospice.
''We told them that unless they had the judge with them when they came, they were not going to get in,'' said a source with the local police.
''The FDLE called to say they were en route to the scene,'' said an official with the city police who requested anonymity. ``When the sheriff's department and our department told them they could not enforce their order, they backed off.''
The incident,known only to a few and related to The Herald by three different sources involved in Thursday's events, underscores the intense emotion and murky legal terrain that the Schiavo case has created. It also shows that agencies answering directly to Gov. Jeb Bush had planned to use a wrinkle in Florida law that would have allowed them to legally get around the judge's order. The exception in the law allows public agencies to freeze a judge's order whenever an agency appeals it.

Well there is a statute that gives DCF the power to take custody of an abused adult. BUT, I read on another thread that DCF then has to petition the court with 24 hours to retain custody. I'm not sure which court the poster was referring to, but with all the problems Jeb is having with the courts it looks like he may not have been able to legally retain custody of Terri. I agree with the guy on another thread who said..."Florida is a legal hellhole."

Not true, D1. Michael Schiavo's brother, and his brother's wife, both claim to have heard her say she would not want to be kept alive under artificial means.
I'm not saying I necessarily believe them (I find the sudden memory of this trio too convenient for my own comfort), but I'm saying Michael Schiavo was not the only one who claims to have heard Terri say that.
Apparently, that has been made a "finding of fact" in the case, which is nearly impossible to get changed, as I understand it.

What in the world does that mean--once the South, always the South. Stupid statement. This has nothing to do with South or North. We in the South value life as much as any other part of the country.
I agree - it will all end up right back in the courts.
And I can't believe anyone could think the courts would rule in Jeb's, or Terri's, favor on anything at this point. They have thrown a temper tantrum this week because the Congress and the President dared to ask them to review the facts of the case - and in the end, they didn't. They're intoxicated with power, and so what if an innocent woman dies, as long as they save face - they're circling the wagons defending Greer, and they have their precious egos to protect.
As Terri's father said, the courts are flexing their muscles and are intent on killing Terri. They've totally ignored new evidence in this case and have ruled in every instance against the Shindler's. Does anyone really think they would EVER rule in Terri's favor on anything if Jeb Bush stormed the hospice and took her out? We're beyond the point where facts matter - it's all about power and ego now, and the courts will NEVER side for Terri.

These local cops are city employees. The police guarding the hospice are employed by the city of Pinellas Park. I've noticed a couple Sheriff's, they are employed by the county.
Each municipality in Pinellas has it's own police force. The Sheriffs oversee unincorporated areas, and assist local police forces.
About her remains: I'm curious how the law will be handled when it happens, seeing how Michael Schiavo has already requested before Judge Greer, that she be cremated after her death. There's been so many charges tossed around, I can't see this sitting well with the family, and others...
My analogy is that we do not want governors with the power to reverse any court decision with which they disagree. Even the president of the U.S. lacks that authority, unless Congress grants it by virtue of their control over the federal courts' jurisdiction. In this case, the Florida legislature failed to pass a law to give Jeb additional authority.

I see........so of course you are suggesting anarchy or something....if we don't like the fact that every court has ruled against them or refused to hear the case then we should just ignore the jucicial system which makes thousands of rulings a day and........well, just have at it???......now that also in your words does not sound "lawful or legitimate"......
Some are arguing that they did not quite have the guts to put what was needed in this legislation.
David Boies,legal counsel (Bush-Gore),and another big wig tonight on Hannity that the ones that really dropped the ball were FL,state legislators.
All they had to do was pass a law that said a husband which is estranged from his wife cannot act as legal guardian in a court proceding agains the wishes of the wife's direct relatives.
Sounds good to me.
Question where were the legal experts last week when Fl.legislature was still sitting and something could have been done?
My bet, every lawyer worth his salt never thought for a moment that the federal judges woould disregard Congress'law.....
Long post to say we still have Judges that don't want to listen to Legislative branch.
Jeb Bush should send a SWAT team in, dressed bulletproof from head to toe and carrying the nastiest machine guns in the whole state of Florida!
