Jeb Bush may take Terri Schiavo into state care
The war over the fate of Terri Schiavo was entering its final stages today as her parents clung to two slim hopes of preventing their severely brain-damaged daughter from being allowed to die.
The 41-year-old has been without food or water for almost seven days, after her feeding tube was removed last Friday on the orders of a Florida state judge.
Friends and lawyers say she is showing signs of dehydration - flaky skin, dry tongue and lips, and sunken eyes. Doctors have said she would probably die within a week or two of the tube being removed.
"It's very frustrating. Every minute that goes by is a minute that Terri is being starved and dehydrated to death," said her brother, Bobby Schindler, who said seeing her was like looking at "pictures of prisoners in concentration camps".
But Brian Schiavo, the brother of Mrs Schiavo's husband Michael who has argued for her to be allowed to die with dignity, strongly disagreed, telling CNN that Terri Schiavo "does look a little withdrawn" but insisting she was not in pain. He added that starvation is simply "part of the death process".
One of the final hopes of Mrs Schiavo's parents lies in the federal courts. Last night Bob and Mary Schindler went back before a federal judge in Tampa, filing another emergency request that the feeding tube be reattached while they pursue claims that their daughter's rights are being violated.
District Judge James Whittemore previously rejected an almost identical request on Tuesday. He promised to work through the night to issue his new ruling.
The second and more dramatic hope lies in the hands of Jeb Bush, the Governor of Florida, who was last night considering the politically explosive step of ordering state officials to force their way into the hospice where Mrs Schiavo lies motionless and take her into state custody, in defiance of the US courts.
A Florida judge yesterday rejected a request by Governor Bush to allow the state to take custody of her, but the governor's aides afterwards refused to rule out further action.
The possibility emerged on Wednesday night, when Governor Bush declared that Mrs Schiavo - who court-appointed doctors say has been in persistent vegetative state for 15 years - had been misdiagnosed. He based his assertion on "new information" provided by William Cheshire, a Florida neurologist, who says that she may only be in a "minimally conscious" state.
Although Dr Cheshire, a leading member of the Christian right-to-life movement, did not examine Mrs Schiavo, he observed her for an hour on March 1. Governor Bush maintained that his testimony was compelling enough for the Florida Department of Children and Families (DCF) to take her into protective custody.
On Wednesday night, amid reports that Florida state officials were "mobilising" outside Mrs Schiavo's hospice, Florida Circuit Judge George Greer issued an emergency restraining order prohibiting DCF agents from seizing her.
Judge Greer then formally rejected Governor Bush's custody request yesterday. Last night he refused to hold a new hearing to assess Dr Cheshire's claims.
He also ordered the local sheriff's department not to allow state officials into Mrs Schiavo's hospice - but, under Florida law, the governor has the power, without court clearance, of taking a citizen into custody for a 24-hour appraisal if it is suspected they are in jeopardy.

I don't know about the rest of you, but this business from the MSM about the fanatical religious right and extreme religious community interfering with the husband's wishes is starting to grate on my nerves. As much as I have respected Mort Kondracke, last evening on the Britt Hume show, Mort came out first with the statement about the religious right trying to influence the outcome of Terri Schavio. Then Juan Williams piled on about the right-wing conservative movement trying to make this political. Really honked me off....this is about life....
Pontius Pilate did not decide--he deferred to angry religious authorities meanwhile protesting that Jesus had done no wrong and did not deserve to die. I do think that if Pilate had said no and taken Jesus into Roman custody, Jesus' death would have been forestalled as he had not committed any crime under Roman law.
Jeb Bush must have a tortured soul today. May God give him strength.
There are not many protestors there. Not hundreds by any count, probably dozens like you've mentioned. I've been tuning in to WFLA 970 and they have someone on the scene.
They report, the same faces, and "dozens" of people.
There's a "listen live" link on their website and they've had somebody at the hospice round the clock reporting on the situation every half hour.

If you think we are a nation of laws, why has Judge Greer gotten by with allowing MS to not file plans of care yearly AS REQUIRED BY LAW. The law is in place to protect the disabled from abuse and neglect. As long as Terri is alive she had the RIGHT to be cared for according to the guarentees in the LAW. In othe words as long as the court fights were going on she should have recieved PT, OT, feeding therpies if necessary, medical care, dental care ...stuff like that. This is wrong just based on the fact that the judge approved denial of services.
Having said that Gov. Bush and the legislature should have pulled out all stops and authrorized overtime for the DFC to get their report done quickly. I really think that it could be proven she was neglected, then it would be possible for them to intervene, but that wasn't done, they decided to plod through the process....so Terri will probably die since on one seems to think she should at least get to live while the investigation is going on.
tell me, do you want to know the results of that investigation? I do, even if Terri doen't make it. I want to know if she was treated as required under the laws dealing with vulnerable adults. Just because a judge says treatment can be denied (PT,OT, ST, medical etc etc) should not mean it can, since it breaks the LAW. ...which you seem to think shouldn't be done. I pray that God continues to hold her in His hands and comfort her when she is probably going through hell here on earth.
Gee if I treated any of my animals this way i'd be fined and probably put in jail. Why is it ok to treat a human by not even offering food or drink by mouth?

Even people in the area aren't going. I haven't seen a single FR sign posted anywhere and they usually are. As far as I can tell the outrage matches the polling data.

You are correct. At this point, he has nothing to lose; and if he wins, he has everything to gain because this is now a national issue.

IMHO Easter Sunday will be the test. If the hospice is not surrounded by those that truly care for Terri than my hopes dim, actually they already have.

Of course they're willing to sacrifice Terri to do it. First they prime the sheeple by having an Oscar winning movie EXPLAIN it all to us so we can see that Right to Die is a beautiful thing.
Abortion was their answer for welfare & now Euthanasia is their answer for Social Security.
For the majority of the electorate, this will blow over as soon as the media finds the next "crisis" to sensationalize.
Soon, we will be returning to the issues of illegal immigration, fuel prices, and tax returns.

The court, in 1997 when Michael announced he was'engaged' should have immediately conducted a guardianship hearing and transfered Terri to State guardianship. Because of this failure, we are in the present situation.
Questions you might consider:
(1) Why did Michael choose to 'ignore' her wishes for nearly 7 years until 1997 when he announced he was'engaged' to Jodi Centonze and 'suddenly' remembered the conversation about life support with Terri from years before?
Michael Schiavo answer would probably rationalize that it took that long before he realized there was 'no hope for recovery...'
(2) However, the 1992 malpractice suit for $20 million was based on the premise/conclusion that Terri would NOT recover and she would require constant medical care for the remainder of her life estimated by Michael Shiavo and his laywers to be 51 years(which is the normal life expectancey)...Where were her WISHES at that time?
(3) The court, in 1997 when Michael announced he was'engaged' should have immediately conducted a guardianship hearing and transfered Terri to State guardianship, at a minimum because of the obvious conflict of interest on the part of Michael Shiavo.
The court system failed to act at that point, and that is a major factor on why we are at the point we are today.
Guardianship, by law and practice, is determined to be given to that person who is most heavily 'biased' in favor of the disabled person. Under most conditions this would be the spouse. However, most prudent courts, if during the guardianship period, the appointed guardian by circumstances or accident tilts the 'bias' away from the interest of the person so guarded, would conduct and immediate review, and at a minimum, transfer guardianship to the appropriate State agency.

Exactly. Instead her family is stripped searched to make sure they are not sneaking anything into her room. I couldn't even watch rats die like that, but I am getting hardened to watching Greer, Felos and Mikey die like that. Especially Greer. He is legally blind. He should be ordered to starve to death for his disability.
This will blow over.
