Schindlers' Options Dwindle to Hearing Tonight with Federal Judge (Motion DENIED)

A federal court hearing has started in one of the last effort attempts by Terri Schiavo's parents to restore their daughter's feeding tube.

But the judge already has turned down the parents once. Bob and Mary Schindler are asking for an emergency order to reinsert the feeding tube in the brain-damaged woman.

The hearing in Tampa is before U.S. District Judge James Whittemore. He turned the Schindlers down once, as did a federal appeals court and the Supreme Court. A state judge, a state appeals court and the Florida Supreme Court also have all come down on the side of the husband, who wants to let his wife die after 15 years in what some doctors call a vegetative state.

The latest defeat for the Schindlers was today when a state judge said he won't go along with Governor Jeb Bush's request to order the feeding tube reinserted. The governor had said that new allegations of abuse of Terri Schiavo need to be investigated. The governor also tried to challenged the diagnosis that Terri Schiavo is in a persistent vegetative state.

I don't blame the president or the governor I admire them greatly.I am saying that they are the ones standing at this time,which I believe is a seminal moment.
How they act will impact this country in a profound way,that will not be washed away by the usual political polemic.
This moment is even moreominous because they are brothers,and the "sins" of one will be visited upon the other.

Why didn't the legislature come back at Judge Greer when he IGNORED their summoning of Terri Schiavo to testify? He just ignored them! Un-flipping-believable!

I'm getting the impression that if the MSM and a certain number of celebrites take a position, that is good enough for at least 50% of the population.

The judge also accepted as the basis of his rulings, the "opinion" of a third doctor who is the brother of a close associate of George Felos, Michael Schiavo's right-to-kill attorney, and very significantly, former Chairman of, you got it again, the same hospice board, Hospice of the Florida Suncoast, which operates Woodside Hospice in Pinellas Park, Florida.

Mary Laybak, CEO of Woodside Hospice has direct ties to Euthanasia Society of America and Hemlock for Hospice, an organization that seeks to accelerate the dying process.  Federal funds may not be used for these purposes.

The Hospice is a federally funded program designed for terminally ill and those whose death is eminent.  Terri has been in Woodside Hospice illegally for three years under Medicaid payments, for free, courtesy of, yep, George Felos. Felos combined and conspired with Michael Schiavo to arrange for Terri's "free" stay at Hospice Woodside as part of an "exit protocol" designed to advance Felos' self-perceived messianic mission of "helping" incapacitated people to die by categorizing them as "terminal," warehousing them, and depriving them of therapy and rehabilitation services.

US Dept of Health and Human Services is currently trying to collect  $14.8 million from Florida Suncoast Hospice, owed to them since 1997. The squeaki-clean(not) Hospice is accused of patient brokering and several lawsuits filed by Attorney Jonathan Alpert are pending.

And back to our friend the judge, just what kind of testimony has he weighted to put Terri in a hell on earth without chance of parole?

Judge Greer refused to acknowledge testimony of 10 doctors and 3 nurses who have cared for Terri and who testify that:

a) Terri is not in a persistive vegetative state

b) Terri is able to be rehabilitated with care and therapy

c) Terri’s original injuries are questionable and consistent with spouse abuse and attempted strangulation

d) Terri has been abused and neglected by her husband; denied treatment for infection and possible attempted murder while in nursing home care (discovery of empty insulin vial and temperature in room set at 64 degrees)

Judge Greer instead chose to believe contrary testimony by two of Michael’s representatives who are:

a) A doctor who rarely sees Terri  (Dr. Gambone who has now resigned as Terri’s doctor)

b) Ronald Cranford, Hannipeg County Medical Center , Minnesota who makes an avocation of testifying in cases such as Terri's throughout the country, always on the side of dehydration and starvation.

You know, I'd rather have folks like your relative, who is probably just ignorant about a lot of things, than those showcased in #134, who are aware of the facts but are more interested in developing pinglists on internet forums for the purpose of stroking their overblown egos.

Thanks -- I thought Judge Bork made perfect sense. Cannot believe some of what I am reading on here. Calling this one of the worst crises of our Nation when we had the Civil War, the race riots of the 60's, anti-war demonstrations of the 60's, etc. There seems to be a lack of knowledge of the history of this Nation in a lot of the posts.

Okay, DevSix, first off, thank you for copying PKM's words. I lose track of all these threads. ;)

I know you and I have agreed on this yesterday, PKM, but I just want to say it again publicly.

I am sad for Terri. I do support Life. But we cannot descend into a dictatorship, as much as we all want to help Terri.

You know, here is an aside. Someone close to me (I won't say it b/c it is a public board) had an abortion. This was, oh gosh, almost 14 years ago. 12 to be exact. Wait, 11. It was '94 (OMG, does time fly).

Or maybe it was '93. Or '92. Whatever. It was when she and I were both young twenty-somethings. :) Although in the '90s I was a 30 something.

Okay everyone please forgive my math. I'm working from memory here. ;)

So this person, I knew, had always wanted a baby.

So she called me up one day and said (happily') "I'm pregnant!"

We rejoiced together but she and her boyfriend weren't married.

He is a very science-oriented person and wanted to "dispose" of the inconvenience.

Suffice it to say that he began to work on her.

I called places, I prayed, I tried to talk to her, but in the end, I could do nothing.

The sad thing is that shortly after that, they got married.

Then they tried to have a baby. And she had trouble conceiving and had a miscarriage, which she felt was retribution, and to this day feels sad about her lost baby.

I don't know why I'm sharing this story except to say that, sometimes, we do what we can. We pray, we call, we work within the law but even despite that sometimes the worst happens.

My husband had a guy at his work say virtually the same thing, but more blunt -- upon viewing a photo of Terri, he said: "Oh, man, she's ugly, kill her." He wasn't kidding.

I shudder to think of the direction this country is headed.

Neither is in sinning - This is where I will completely disagree with you -

I will also disagree with what you see as the ramifications of this case - I see a larger values based turnout in 06 - This is a terribly sad situation - (but it will not have the wished for negative effects on the GOP that some are speculating....be those wished for or not).

You see a corrupted judiciary and you're blindly blaming the President. How unfortunate.

That's about. The law was flawed, allowed oral declarations with no corroboration, the judge erred in allowing that as the basis of the decision. The Shindlers essentially had no standing in that trial and no with standing wanted a jury trial. Whittemore could have corrected that but chose not to do so. DCF (not JEB) is constrained when taking an "at risk person" into custody. The law is also fairly explicit in its requirements.

I believe both Bushes have acted to extent possible within the law. A higher power will judge Felos, Schiavo, Greer, et al.

So the Bushes are "cowards" because they don't just cast aside laws they don't agree with?

Foundational law, constitutional law, requires the executive to protect life, and put up a fight sometimes with the judiciary. (Checks and balances, remember?) The courts have refused to hear the case, let me remind you, OF TWO PARENTS WHO WANT TO FEED AND CARE FOR THEIR ADULT DAUGHTER WHO HAS BEEN ABANDONED BY HER ADULTEROUS HUSBAND. Get it, Sinkspur?

Or have you kicked your boot silver so far into your donkey that you're looking back at reality through the flames of hell?
