From the Desk of Judicial Watch President Tom Fitton:
Dear Friends and Supporters:
The arrogant judiciarys failure to respect life and the
expressed will of the people through their elected
representatives in the U.S. Congress manifested itself in
condemning Terri Schiavo to death today. Thus far, the
courts have failed Terri and the American people. The
entire purpose of the statute passed earlier this week by
Congress was to give the federal courts a new and
adequate opportunity to consider the parents' claims. To
find in such a short period of time (less than 48 hours)
that the parents have not demonstrated a sufficient
likelihood of success on the merits of their claims and,
therefore, a temporary restraining order is not
warranted, eviscerates the clear intent of this
extraordinary statute, the express language of which
calls for a de novo review of the parents' claims
"notwithstanding any prior state court determination."
Such a fresh review of this lengthy and complicated
matter cannot be achieved in so short a period of time.
It is difficult to say the parents have even had an
adequate opportunity to present their claims, much less
demonstrate a likelihood of success on the merits. A
stay is warranted to preserve the status quo (Terris
life) until such time as the matter can be fully briefed
by the parties and considered by the district court.
This should be clear to our federal courts.
Absent further government intervention, Ms. Schiavo will
die of dehydration; a slow, grueling death. This form of
death entails less blood flow to major organs the
brain, kidneys, heart, lungs and skin. The kidneys stop
functioning and the body cannot expel its waste. As Ms.
Schiavo grows weaker, her breathing will become more
difficult, taking in less oxygen and expelling less
carbon dioxide. U.S. law forbids animals to die this
way. Ms. Schiavo is being subjected to a cruel and
inhumane form of torture that violates her fundamental
rights and human dignity, under both federal and Florida
state law. Gov. Jeb Bushs administration should have
acted on our complaint to the Florida Department of
Children & Families that we filed back in October 2003.
Had he done so, Ms. Schiavo may not be facing an
excruciating death. Gov. Bush ought to take every action
under the law to protect Terris life. Ive been
consulting with Judicial Watch lawyers, friends on
Capitol Hill, and other conservative leaders for more
options as well. It looks dark. One last move Ive
been pushing is for Congress to try to enforce its
outstanding subpoena in the Schiavo matter. The U.S.
House could vote the appropriate party in contempt of
Congress and refer it for enforcement to the Department
of Justice, which then could run to federal court to
enforce it as a way of protecting Ms. Schiavo as a
witness/subject of the investigation. This would be a
long shot but must be considered. In the meantime,
our prayers go out to Terri Schiavo and her family.
Tom Fitton President
It's so sad that her parents are deprived the chance to love and care for their own daughter.
God Bless President Bush for trying to go against the powerful federal judges.
We no longer live in a nation of laws, but in a nation of appointed-power-hunger judges.
Is this what it's all come down to?
Life and Death -- based on which political party appointed higher judges?
Look how the evil the Clinton's brought to our nation, continues even to this day....
Dr. Laura had no tears for her own mom who died and no one knew for days.
How much more would a president Hillary fail us?
Never let it happen, America.
How do you know the tears someone cries?
Terri Schiavo's parents are crying.
Her brothers and sisters are crying.
And I cried today.
Prayers sent.
Thank you, Mr. Fitton.
We *already* let it happen. God have mercy on U.S.
Many have exploited her tragedy for their own reasons.
The governor of the state of Florida didnt have the you-know-whats to write and Executive Order and save her. May any aspiration for a further political career cost him.
THis is a joke, right? oy.
Tom,
I don't think you need to go to congress to get a contempt citation before the federal government can step in. Under 18 USC 1505, it is a felony punishable by 5 years in prison to harm a witness to a congressional investigation. Federal law enforcement steps in all the time to prevent violation of federal law. There is no reason why the FBI or the Marshall's service couldn't step in to prevent an illegal act, the killing of a witness to a lawful congressional inquiry.
I fear our republic is toast.
Dr. Laura's mother chose to live in isolation. C'mon, not now.
If memory serves me right, they didnt get along; but I could be wrong.
If not, there are personal/private reasons. For me, when my father passed away, friends and family knew, of course; but I refused to share that with the hypocrites in my office. I didnt want them at the funeral pretending they cared. The day of the sevice I just took the day off with some excuse. Since he died over a weekend in the States, they were none the wiser. My older brother flew to the states and made the arrangements. The ashes were brought to Panama, and we held a proper service for him.
Rush once opined that any law on the books is only as good as someone's willingness to enforce it. This is a deathwatch for the rule of law as well as for Terri.
Did you hear the feminist N.O.W. babe on Rush today say that Michael Schiavo is the "keeper" of Terri? Anything, anything to keep the "right" to death.
Who will be our "keepers?"
Maybe this case is making us all realize that
people ARE being starved to death by family
nursers and doctors!
I really didn't know this horror existed!
You, and many others. What is the saying..."Only in America"...?
