As maddeneing as it is to watch I'm begiining to believe we're seeing a very carefully constructed process executed driven by the Executive Branches of both the Florida and Federal Governments (read: Jeb and W) that at it's heart is meant to save Terri's life. The tricky part is they're trying to do it in such a way that respects and uses to full adavntage the three distinct jurisdictions of constitutional authority.

The Legislative Branch is now out of the picture, both in Washington and Florida. The only Judicial point not yet explored is the USSC, but FOX is reporting that is now underway. If Kennedy blows it off (I think he might...no specific reason, just a hunch) the Judicial Branch options will have been exhausted.

Which leaves only the Executive Branch, which at both the Federal and State level have openly expressed their desire for Terri to live.

The hearing allowing DCF to take custody of Terri is simply a sop to the part of their enabling legislation that covers normal circumstances. If it's refused they can immediately go to the emergency provisions and remove Terri and not have to justify it before a court until at least mid-next week.

Once again, Bush let the Legislators recuse themselves, let the Courts run to the end of their script, and can now, with full authority, bring the power of the Executive Branch to bear and no one can legitimately claim he's usurped the authority of any other Branch. To make things even better, the section in the DCF statute is not new law, yet reads as if it were written to protect just such a person as Terri.

And if all this fails, I wouldn't be surprised if W has an Ace hiding in his boot.

I keep remembering Gov Bush mentioning that he thought if Terri could hold on 36 hours, she could be saved.

It seemed a little long at that time and I wondered about it. I also wondered why they mentioned they would contact Judge Greer as a courtesy. Maybe they are the ones laying the trap.

(Lets keep it quiet and just know that God knows what is going on and it will all work according to His purposes in the end. Evil will not win.)

Good Post... DCF clearly has the right to take her into protective custody, injunctions by Greer mean nothing.

DCF's job within the state is protect even without a direct court order. Act first then file in court. Thus giving them at least 24 hours or so before they file in court the reason for taking someone into protective custody, by that time they will have her feeding tube in her and it will not been taken out again until a full investigation has been done in which congress voted for over the weekend.

DCF will take her into protective custody on the new findings that she may not be PVS and that neglect has occurred and is currently present and that her guardian is allowing this to happen to her even if the guardian is Greer or Mikey.

Wow I've been wondering what Mitchbert wrote so eloquently. I hope it's true. But even in Terri's right mind, W couldn't ask "Would you mind being without water again for maybe a week or more?" And he couldn't have secret negotiations with her family asking them to do this, because they could never say yes. It could be in his thoughts. But I don't think so. I think the level of evil always surprises him and he's never prepared. I guess none of us are.

What Mitchbert wrote might come true...it will definitely be interesting if this is a positive change for America, or another Roe change.
