It appears that Section 2 of this law operates separately from the petition filed under Section 1:

2) EMERGENCY PROTECTIVE SERVICES INTERVENTION. --If the department has reasonable cause to believe that a vulnerable adult is suffering from abuse or neglect that presents a risk of death or serious physical injury to the vulnerable adult and that the vulnerable adult lacks the capacity to consent to emergency protective services, the department may take action under this subsection.

Further, emergency medical care is permitted under Section 2.

A hearing must be held within 4 days of taking custody of the individual to establish the reasonable grounds to continue emergency care.

I don't know the jurisdiction of this hearing.

Yeah but as I feared and was confirmed on Hannity the restraining order on DCF,may trumo the emergency measures. THen the DCF would be in contempt. But i am sure that the restraining order cannot possibly cover every emergency situation possible,like surely Terri just like any other patient would have to be removed if there was a flood or a hurricane destroying the building,or a fire doing the same.
I don't think the restraining order can be a blanket one.
