He said that the Deparment of Children and Families was investigating and had a doc from Mayo say that she isn't in a vegetable state. He said that legally the DCF can take her into custody. It isn't known if they will.

I think it was expected that Greer would deny their request. Correct me if I'm wrong, but I understood from the earlier press conference, that the DCF could take protective custody of her. I think they were putting it before Greer first, he would deny, they can then act. I hope I am right on this.

He doesn't have the legal authority, under the current interpretation of the law.

But that interpretation of the law is the result of what the courts have said the law is over the years, and Executive and Legislative acquiescence to those interpretations.

What I am saying is deadly clear: the Courts have ordained that this woman shall die.

The Governor of Florida can save her life by breaking the law as it is currently understood, and acting with his executive command of the police forces.

He will need to assert a basis for doing so, and the basis has to be that as Governor he has a constitutional duty, under both the Florida and US Constitution, to protect the life of a citizen in a case where the Judiciary has erred in a right-to-life case, just as he has the power to pardon in a criminal case.

This will be a direct defiance of existing law, as understood.

He will then face a blizzard of court injunctions, and he must defy all of them on the same principal, and fire any officer of the Executive Branch who obeys a court and disobeys the Chief Executive on the issue.

This forces the issue into the Legislature, where it will either impeach him for breaking the law, or it will not, in which case he will have established the precedent, by his actions, of Executive oversight in Right-to-Life cases.

It would require Bush to be willing to literally rewrite precedent by defying it and risking impeachment.

Morally, he has no real choice here.
He has the power to act to save the innocent at great cost to himself.
This is Easter week.
The Savior of the world acted to save the guilty at the cost of his own life after hours of torture. By contrast, what Bush faces is a few months of people calling him nasty names and threatening to take his job away...and ultimately FAILING because there are not enough Democrat votes in both houses of the Florida Legislature to impeach and convict Jeb Bush if he directly defies the Court and establishes a powerful new precedent.

Huh.

Name any ten (fifty?) Republicans with the collective testosterone level to even THINK along the lines you describe, much less ACT. Anne Coulter has more testosterone in her ballpoint pen that the whole Republican Senate delegation, but she holds no office. Maybe getting elected to the legislature, State or Federal, marrs the psyche in some perverse way...

Sorry. The Republican party top tier is chock-a-block with pantywaist pushovers; Frist being Pantywaist-in-Chief. When the going gets tough, the Republican party sure gets going -- going out to lunch. Spinach quiche anyone??

Take it as my "no confidence" vote. Schiavo is toast, barring Divine intervention, as Republicans will certainly not be riding to the rescue, this time.

It is clear that the judicial system is this country is going to show no mercy to Terri Schiavo. Asking Judge Greer to spare her life would be like the Jews at Auschwitz begging their Nazi guards to spare their lives. It is not going to happen.

Nor will the political system show her mercy. The FL legislature has made it clear they want her to die. Her blood will be on their hands and may God forever damn them for it, as well as any who have advocated that this innocent person be put to death.

It will remain for the few individuals in positions of power and authority who can do something to save this person, who have some shred of decency and morality about them. Are there any out there? I didn't think so...

When all this is over I hope someone looks into Judge Greers court. There are probably other people he is ordered knocked off that we don't even know about.

He has to do the right human thing, so far it seems he is not willing to. I thought better of him--maybe only because I have such genuine trust in the goodness of his brother. Now I am disappointed--but praying.

Without Jeb, Terri would have been dead a few years ago. Without Jeb this never would have gone as far as it has. How DARE anyone sitting in comfort before their computer screen question Jeb's heart and, further, ACTIONS on behalf of Terri. he's done more than ANYONE on this board for her.

What an excellent analysis. That would take some gargantuan courage on the part of the Governor, but fortune and hopefully Our Lord, favors the bold.

I like the idea of the executive branch having parity with the judicial.

I disagree that this was "stupid political timing" by Jeb. He has his brother's instincts, and almost assuredly had his next move planned in the event of either outcome by the Florida legislature.

Jeb's heart is in the right place, and he's extremely shrewd. I'm glad he's on the side of life.

You have to keep in mind that the Republicans are full of RINO Judases who flip when the vote gets really tight. The pro-death people couldn't risk a one vote margin so they called on one of their moles. That person should be identified and FReeped at the next election.

You are probably right.

Which means that it comes down to just one more thing: the nuclear option.

If neither Bush uses his power and boldly and defiantly acts, and dares the minority opposition to attempt to impeach him for doing so, Terri Schiavo will die. And the Republicans will be the weaklings you say.

But men are weak, and afraid to break from precedent to do bold and potentially dangerous things.

That being the case, there remains the issue of who will control the Federal Judiciary in the future, and that could still go to strict constructionist conservatives IF, and ONLY IF, either the Republicans in the Senate exercise the nuclear option, or the Democrats cave.

Democrats have balls.
They never cave.
Never.

That means that the Republicans will either use the nuclear option, or the Democrats will prevent the change of the judiciary.

And then it will be two clear cut cases in which the Republican Party had the power to preserve life and advance the Right to Life agenda by taking bold, controversial action, and failed to do so.

I will be through with them at that point.
No more money. And no more votes.
If they will not save lives, they are merely interested in tax cuts, and that is not my agenda.

Of course, I have perhaps more faith in Bush testosterone than you do. I think Jeb Bush may do the right thing.
