On Fox News Channel, Martha McCallum just announced that Florida governor Jeb Bush will make a statement on the Terri Schiavo case at 3 PM EST.

It's apples and oranges, I'm talking about a choice you would make when you're 24 years old because that's how old she was when this happened.

I supose you missed my post where I stated I had a living will written up when I was 24 yr. old ??

So, anyone heard anything else on the legality of JB and DCF siezing Terri? All Fox has said is that the judge ordered DCF not to interview. Not discussing the legality of the order or the right the governor and DCF may have to do so.

I am going crazy!

Did you know that the Terri went to live her parents in 1991 and they brought her back to the home about two weeks later because they couldn't take care of her?

Did they take her to the home to better care for her?

Or did they take her to the home and walked away and wash their hands??

There is a difference

Example .. I had an Aunt who has suffered a stroke

Her children couldn't take care of her and her needs by themselves so they placed my Aunt in a nursing home

Though they did this .. they also visited her everyday and brought her things she need

On this thread or one of the earlier threads, the DCF regs have been posted. To paraphrase, the DCF may take a disabled person into custody after requesting the guardian to do so. If the guardian is perceived to be responsible for neglect etc., then they have to get a court order to remand the "patient" into protective custody.

To make sure I am correct in my reading - I will go back and look for the regs. I don't remember which Freeper posted them.

Thanks for the regs. This is the best part: "If the vulnerable adult's caregiver or guardian is present, the protective investigator must seek the caregiver's or guardian's consent pursuant to subsection (4) before the vulnerable adult may be removed from the premises, unless the protective investigator suspects that the vulnerable adult's caregiver or guardian has caused the abuse, neglect, or exploitation."

This slows things down however. "The department shall, within 24 hours after providing or arranging for emergency removal of the vulnerable adult, excluding Saturdays, Sundays, and legal holidays, petition the court for an order authorizing emergency protective services."

Thank you, I am a legal doof. So, do I understand correctly that they have to have a court order? If so, then we have to rely on the fact that there would be a judge willing to sign such an order.

I don't want to be a pain, it's just when you keep hearing conflicting things, it's hard to know what is correct and what isn't.

I read they can take the vulunerable adult with out approval of the guardian if they believe the guardian to be responsible for abuse or endangerment or if they thought the life of the vulunerable adult was in danger.


Paraphrasing it and boiling it down, it seemed to say:

"If he/she is in danger get him/her out and the go to the court."

But I'm not a lawyer, only a citizen watching the decline of the state of Florida and our judicial system....

I would consider you very selfish if that's what you would expect if you were 24 years old from the man you married.

IMO .. If one can not honor their vows .. especially before God

Then they should not get married

I have not read the report, so please, give me a link for it.

Has Michael allowed any physical therapy in the last, say, 5 years?

Has Michael allowed the doctors and nurses to attempt to give her water or food BY MOUTH? I've heard reports from many nurses stating she CAN swallow, so why not let her try?

If he doesn't want her in his life, and wants to move on, fine, DIVORCE HER. Heck, he could have the marriage ANNULED (if it's important to him for his Catholic faith). However, if that is, why isn't it important to honor his marriage vows in the first place?

Please tell me the person to make that decision is not our friend, good ol' Judge Greer!

My guess is he'll have nothing to do with it or alternatively be trapped in a box where he will have no choice but to burn those who have been on his side before just to protect his own backside.

I see a perfect Bush-ish trap here, and if it works it will be a wonderful thing. No one will be left with an inch of manouver room when this is done. If Terri gets out of that hospice alive, my bet is game's up for Michael, his lawyers and Judge Greer. Maybe the hospice, too.

Hannity says the Judge Greer as stopped Governor Bush.
There is no other option but executive order. Hannnity said he talked to a constitutional attorney before he came on the air and he thinks GREER is the one who set a trap for Jeb.

How could it be GREER who set the trap for JEB. Doesn't the state law allow for the DCF to step in...without consent of the Judge...?

I do not know the state law. However, Hannity and the parents both agree that Greer's restraining order is legit. *shrugging*

I do not think Jeb is being coy and playing games.
I think if DCF could remove Terry they would have already.
So I am assuming that Greers restraining order is not out of bounds.

Of for pete sakes! Not getting better because she hasn't received any THERAPY for ten years! She had 4 teeth removed because sweetie-pie "husband" told the nurses that NO oral hygiene be allowed. For those in Rio Linda that means he even told them that they couldn't brush her teeth! Any medical facility that followed those orders should be CLOSED DOWN for abuse. Get over yourself and the fed. For once they are making a statment about life and rights (for the disabled not just Terri) God bless them for doing something important for once!
