The feds can review the case for judicial error, but they don't start over from the beginning. Actually, the bill gave the federal courts the authority to start de novo, so yes, they could have started all over, from the beginning. In order to do that, however, the Schindler's needed to score an injunction ordering the feeding tube to be put back in pending such a hearing. They didn't get one from the district judge, now they haven't gotten one from the 11'th, and Anthony Kennedy isn't going to give them one either.
