Schiavo 'fading quickly,' parents tell court

TAMPA, Fla. - Warning that Terri Schiavo is "fading quickly," her parents begged a federal appeals court Tuesday to order the severely brain-damaged woman's feeding tube reinserted while they pursue claims that her rights are being violated.

David Gibbs III, attorney for parents Bob and Mary Schindler, told the 11th U.S. Circuit Court of Appeals in Atlanta that their 41-year-old daughter might die before they get a chance to fully argue their case. The appeal came after a federal judge in Tampa rejected the parents' emergency request earlier Tuesday.

"Where, as here, death is imminent, it is hard to imagine more critical and exigent circumstances," Gibbs said in the appeal, filed electronically with the court. "Terri is fading quickly and her parents reasonably fear that her death is imminent."

Rep. Weldon also said he was surprised at how fast these federal judges were denying the appeals since he thought that a thorough review would take at least a couple of weeks.

The way I read the bill, the Federal Court was ordered not to automatically accept the state trial record as fact. However, when Gibbs only presented what amounted to an appellate argument based on the state record in support of a motion, the judge ruled on what was in front of him.

The judge wasn't going to call witnesses and present the case for the Schindlers, and the bill can't be construed that way.

I really believe St. Pio is the right person to turn to. He knew the face of evil here on Earth and he fought it so hard. He would also interceed for the sick, and brought about many bodily healings.

St. Pio, pray for Terri and help us all in this fight. God has listened to your plea on so many occasions, please interceed for us in this our of darkness. Amen.


If Terri dies the Catholic Church should declare her a martyr.

What a contrast to the police and firefighters who gave THEIR lives trying to save others on 9/11!!!

I wish someone could shame these police into going on stike over this, or at least "looking the other way" as water was given to Terri. This is despicable, that an officer of the law would participate in the forced death of an innocent woman. The job description sounds a lot more like concentration camp or Gulag guard that local police officer . . .

For all of history, when men struggled against the oppressive force of tyrannical leaders/governments, the cry for justice was not bound by the law. Are we to believe that the courts are bound by the law? In what way? Because they self-pontificate on their existence? No, they rule based on opinion, in absence of the constitution, to justify their will and not of the people. Shall we examine what the court has ruled constitutional, yet there is no reference implied or otherwise for such rulings. Our courts today, a tyrannical and unaccountable legislative body who believe that they have the power to enact law and to ignore the constitution and indeed enforced by the congress and the president in their inaction to stop this misjustice.

Desperate times call for desperate measures... do what is right, not what an unelected and unconstitutional court decides is right, and let history be our judge.

Are you a lawyer or do you just play one on here? You are very wrong - the governer or the president have the power to save her life - rather than explain please re-read through some of the other posts.

You know, a governor in Illinois recently overturned around 160 death sentences by executive order. He went against the will of 160 juries, and nobody screamed abuse of power, now did they?

Actually, some people did. However, those were state cases, and the state of Illinois provided the governor of the state the power to actually do that (The clemency laws are among the broadest in the nation) so in the end, there was nothing that could be done to change what he did. He legally had the power to do it. Whether it was morally right is a whole 'nother thing, though...

No, he was applauded for his "compassion" in pardoning vicious murderers.

And he was criticized harshly by the families of murder victims, and vi=ctims advocacy groups, too.

Terri Schiavo is INNOCENT. She's done nothing wrong to deserve this horrific death sentence.

I don't disagree with that.

Very few people are going to have a problem with the President or the Governor pardoning an innocent woman.

Well, I won't have a problem with it either, provided that the president can actually interfere in this case, and provided that the president has the legal power to actually issue clemency (or a "poardon", which makes no sense) to an innocent person...

Even Jesse Jackson, of all people, was lamenting the fact that they are starving her to death. He said tonight on MSNBC that this was totally wrong. And he's no friend of George or Jeb.

Even a stopped clock is right twice a day...

The bottom line is this - quite simply, holding the president responsible because Terri Shiavo dies, is just as idiotic as saying that america is becoming "Nazi-like".

Oh, I have. Believe me, I have. Wanna talk about how America, at one time, actually had Nazi-like Eugenics laws? We dont' anymore.

I just don't see how America is becoming "like the nazis". Granted, the liberal left acts like it often enough, but America itself? No, I just don't see it.

I know. I can't imagine doing what those officers are doing. However, they are following orders. Doesn't that cause a shudder to go through your body? There are a lot of people who see nothing wrong with this. They believe that this is the right thing to do. The poll that FOX News took shows that the majority of people feel that this is the right thing to do. Only last night did the family start telling the stories about how they feel Michael might have been involved in her collapse. So many people that I have talked to about this case have never heard all of the allegations that we have discussed on FR.

The good thing, if I may say so, is, like Michael Savage said the other night, that masks are down. We see the face of evil very clear now and we see who stands for evil. It's black and white now.

I really want her to live, though.

It appears that the Deathocrats and the ACLU are winning the battle. May they end in hell for this murder and many others for which they are responsible! Abortion was bad enough. Now we have murder in the rest home fully justified by RATs and the leftist judges. Is the Republic toast?

Where are the feminists? We a have cheating husband who has two kids with his "fiance." We have friends and family who suspect spousal abuse, perhaps even attempted murder. We have a female coworker who claims Terri was about to leave her over-controlling husband before the "collapse." We have a nurse saying the husband refused rehabilitation and asked when the "b---- is gonna die." But not one Women's Rights Group speaks for this poor woman, whose future has been placed in the hands of her abusive husband who hates her.

I watched a loved one starve to death [only I didn't know it till I read the death certificate]...It's a horrific death of pain, thrashing about and great suffering!

Extraordinary means is breathing tubes etc....it is not the withholding of food and water... That is Euthanasia! It's evil. It's immoral. Pray for a miracle.

All of those orginazations are bogus. Them not showing up to help Terri proves this. I can tell you this is all about POLITICS. The left does not want Terri to live. They want to blame Jeb, President Bush everyone but Micheal.

The Catholic Church should officially state her Martyrdom. Its Ironic that Terri is being put to death by the State during Holy Week. Those people who know that this is murder and don’t stop it are as guilty as Pontius Pilate and will have to answer to Jesus Christ, the ultimate Judge someday.


I have been listening to Michael Savage this whole week & bravo to his gallant defense of Terri & also taken on the Nazis I mean Democrats (I am sure there are Republics who fit this bill too) in this country. Some may not like his bluntness, but he tells it the way it is.
