I have not seen the new law passed early Monday, but didn't it call for de novo review by the federal court? If so, how can he rule on a TRO by basing a decision whether to preserve the individual about which the de novo review is supposed to occur. This judge seems to think he was only supposed to review whether there were procedural steps that were observed. This is very puzzling. I thought the federal district court was supposed to inquire about her constitutional rights to life and liberty and if they were wrongly taken.

Generally you make sure a record is made which shows you present the info to the judge so you box him in.

FNC has some looney woman (with a really silly haircut) She is blasting the video saying that the national debate violates her privacy right and that people should consider the video random and irrelevant.

The legislature enacted the law arguing that manifest harm would occure without the temp injunction.

The judge ruled on in based on a substantial likelihood of sucess standard. Essentially, the legislature got out nitpic lawyered. They should have included temp order language which said "shall issue temp injuction." There was no way they could have seriously anticipated this clinton appointee's weasel effort.

It is very reasonable to have believed procedure would have had a different result.

Doctors have stated that Terri is swallowing between 1 and 1 1/2 liters of saliva a day. She can swallow.

So yes, I would say we do have a big problem. One thing to take out the feeding tube, quite another to not allow medical personnel or her family to even offer her food or water by mouth.

I heard that Terri's doctor said she can eat on her own without the feeding tube. If this is the case and food is being withheld, we have a BIG problem.

Judge Greer issued an order that once her tube is removed, "I don't want anyone trying to feed that girl!"

By his judicial decree, not only is the tube removed, but no liquid or food is to be brought near her lips. That is akin to removing someone from a respirator after surgery and pinching the nose closed and covering the mouth just to make sure they won't breathe on their own. Despicable just isn't a strong enough word to describe this man.

Normally I would agree with you about parental rights but I always believed that Elian an exception because his father had no choice. I understand that others felt differently though. It caused (among snubbing our military) Al Gore presidency IMO. Terri dieing is not going to "make this go away".

I'm not a nurse .. so I don't know why she would have to do that

I would put dextrose in Terri's mouth to counteract it. This happened about five times on my shift, as I recall
