Some of our viewers are writing in and saying if this goes to the 11th circuit court and that court rules to reinsert the tube, clearly michael schiavo would appeal that rulinG. Where does it go from there?

>> Well, that ruling would take effect wile michael schiavo was appealing. In other words, it would be an emergency order to keep ms. Schiavo alive and that would go into effect while mr. Schiavo was appealing. It would go for a rehearing first in the court of appeals, that's the 11th circuit court of appeals, a rehearing beef the entire courtS. See the first hearing in the court of appeals is before a small panel, three judges, and then there could be a request for an appeal to the entire 11th 11th circuit, which is a much bigger group of judges, and then if that's rebuffed, then up to the united states supreme court, and it would be up to the united states supreme court as to whether or not to take it. So there are dsh -- kiran: Which they refused in 2001 to hear the case.

I would say it's very important for your viewers to realize that when congress passed this law about terri schiavo, they -- all they did was open the doors of the federal court. So after all of this is over and done, all of the federal courts might stand by the state courts, and just reach the same decision. >> Yes, there could be now -- that is why i raised it, there could be now federal legislation from the congress attempting to tell the federal courts what to do with this case, to basically reconnect the tubes, telling the federal courts that there's been some vile lags of -- violation of rights, terri schiavo's rights or at least setting up some kind of test for the federal court to apply. All of which they did not dO. Now, if they did legitlate in this way, there would be big questions about whether congress could do that, but I'm not saying it wouldn't be sustained necessarily. This is all unchartered seas, this is extremely unprecedented, very exciting for somebody in my position who studies the law. Kiran: It's also tragic as we see this debate played out over and over again.

Does it sound to him like the florida court has said we're not reinserting the tube, we're not going to consider the merits of the cares and it's now being pumped up to the 11th circuit?

States' rights... I have to run for work but...

What about state's rights in the Rodney King incident? Didn't local courts give the cops a pass, then the feds stepped in? Hasn't this sort of thing happened before and precidents set?

BTW while I am actually a strong believer in state's rights, I would like to see Terri have a chance at life. What should the feds do if a state's judicial branch melt's down due to cronieism, payoffs, etcetera? Is there some course of action for that instance or is that something that needs to be addressed?

Not sure what the German is translated as, but one must remember that Margaret Sanger can extremely strong ties to Nazi Germany, and the Super Race Concept. This is a person that Hillary Clinton considers to be one of her heroes, along with a number of other liberal women Senators.

Sanger was the founder of Planned Parenthood, and Planned Parenthood worked hard to get pornography legal. [The ties between his judge and "best friend" who is so into pornography are not surprising].

Seems like Barbara Mikulski, Barbara Boxer, Diane Feinstein, Hillary Clinton all need to be exposed for their ties to the Culture of Death.

This unfortunately is going to get academic. Even at some point if the tube is reinserted, would there be a point of no return?

The appeal has to be made on Terri's behalf. There is an exponential risk of irreparable harm as time passes without nutrients. This will go to the Supremes. They will have to consider it after the act of Congress.

What would it take to bring criminal charges against Schiavo for neglect?

Exactly! How many of us knew what the outcome would be when we heard this judge was a Clinton appointee? One wonders whether President Clinton, in the light of his own recent health problems, regrets appointing someone who has ruled this way on this life issue.

Hey! We'll have none of that "Following the Law" and "Respecting the Constitution" around here!

Would that be the law of disregarding the constitutional authority of congress when issuing the subpoena? Or would that be the law of this judge ignoring the constitutional authority of Congress in assigning jurisdiction of this case to the federal courts and moving that the tube be re-inserted while the case is once again reviewed?

Do you wear the proper religious symbols when you make obeiscance to judges overriding the will of the elected, constitutionally mandated people's representatives in Congress when they exercise their authority as granted in said Constitution?
