The Midnight Coup (Los Angeles Slimes MEGA-BARF Alert)

Republican leaders, eyeing an opportunity to appease their radical right-wing constituents, convened Congress over the weekend to shamelessly interject the federal government into the wrenching Schiavo family dispute. They brushed aside our federalist system of government, which assigns the resolution of such disputes to state law, and state judges. Even President Bush flew back from his ranch to Washington on Sunday to be in on what amounts to a constitutional coup d'etat. ....

Congress does act in other extraordinary cases on behalf of a specific individual, such as when it grants someone U.S. citizenship. But here, Congress is breaking new ground, trying to overturn a judicial decision by altering the Constitution's federalist scheme. This is the family law equivalent of the constitutionally banned "bill of attainder," legislation that seeks to convict someone of a crime.

The praying, chanting protesters outside the Florida hospital where this drama plays out are a hint that this is the new front in what began as the abortion war, an effort to translate religious dogma into law under the right-to-life banner.

I'm amazed any one would find THAT controversial. Here I thought we all agreed preserving life ought to be the highest of American values. Not according to the LAT editors, if that value happens to benefit the Republicans in '06.

I never heard so many scumbag liberals invoke "states rights" as I have over the past few days.

LOL Segregation was a "state right" as well was it not?

Now they seem to think that it is a "state right" to take a disabled American citizen, a woman who is guilty of no crime, refuse to let her family see her, starve her to death and deny her the right to live.

Why Judge Greer and his cohorts are not being tarred and feathered as we speak is beyond me.

They've been aborting their voters for decades. Now they've decided the country needs to be aborted as well. There is a consistency to their infernal logic that has to be commended. When it comes to death, the Democrats DO stand on principle.

Agreed. They invoke exactly the opposite argument on behalf of vile murderers. But no one wants to point out the hypocrisy. Republicans are guilty of it. Democrats after all, are paragons of virtue.

That's it! Its all those religious fundamentalists forcing their narrow views on the rest of America. I believe Kinsley said as much in today's editorial, to quote:

What crime has Terri committed? It sounds more like a Congressional pardon to me. A pardon of someone who has been sentenced to death for what she is, rather than what she's done.

Yes, it is one of those sneaky coups that takes a majority vote in each house and the signature of an elected president. When you look at it, every elected Federal entity had to support this action. Hardly a coup.

Yes, where is this memo? Not a bad idea to "use the Democrat no votes on the Schiavo case for political hay", but I heard a dozen people say it, where is the memo?

Didn't the Republicans produce a memo that showed the Dems./Rockefellar purposeful obstructing before?

Its not a crime. Any fair minded person reading the law will see that grants Terri's family standing to have their daughter's case heard in federal court. And unlike a bill of attainder, NO judgment is made on the merits of the dispute and Congress certainly didn't hand down a sentence. I guess its too much work to ask the LAT editors to go back and read the text of the law before rushing off with a half-ass editorial attributing nefarious motives to Republicans.
