The Federal court should bar Michael Schiavo from having further personal contact with Terri, and appoint a legal guardian until everything else is resolved.

I would guess that he will move to have the constitutionality of the law decided before an emergency order, with of course the aim of mooting the case.

Thanks be to God for President Bush. What happened to the legislation President Ronald Reagan signed after the starvation of Baby Doe in Bloomington, Indiana in the early 1980's? Just like Michael Schiavo- the parents had offers of adoption so the baby could have surgery to correct the anomalies supposedly "incompatible with life". They refused so they could do the "compassionate" thing and starve her to death.
We are crossing a Rubicon with this current struggle for Terri's life.
We will pray for a miracle for Terri and for the presservation of a culture that revers life!

Yes, but the judge has to find a likelihood that the Schiavos will ultimately win. They must be able to convince the judge that it is likely some enforceable right has been violated. The wrong judge might not issue the order. IMHO that is uncoscionable in light of the risks to Terri (death) and the action of Congress, but it could happen.

President's steatement-

Today, I signed into law a bill that will allow Federal courts to hear a claim by or on behalf of Terri Schiavo for violation of her rights relating to the withholding or withdrawal of food, fluids, or medical treatment necessary to sustain her life. In cases like this one, where there are serious questions and substantial doubts, our society, our laws, and our courts should have a presumption in favor of life. This presumption is especially critical for those like Terri Schiavo who live at the mercy of others. I appreciate the bipartisan action by the Members of Congress to pass this bill. I will continue to stand on the side of those defending life for all Americans, including those with disabilities.


Thanks to the President, Bill Frist, Tom Delay, Jeb Bush, Congrss and the House!

Now we move to the court. Everyone keep praying and keep up pressure.

A valid question, one the has been overlooked by the conservatives on this forum.

Of course, maybe now they will get her some real testing and some sound diagnostics, not a blood brother of Jack Kevorkian doing the diagnose.

Because "attainder" refers to an individual who is imprisoned or has his property confiscated.

This bill doesn't do that, instead it gives federal court jurisdiction, the Consitution specifically gives the Congress the power to define jurisdiction for the judiciary.

The congress is permitted by special provision of the constitution itself to determine the jurisdictions of the federal courts.
