I'm a lawyer and my first thought was that it was a bill of attainder. However, I lookd up the history and a key element is missing. A bill of attainder seeks to punish a single person without trial. Here there is no punishment therefore it should pass constitutional muster. Some examples of bills for single persons. Chrysler Bail out, Bills making individuals citizens, Gold Medals for Schwartzkopf at end of Gulf War.

Why or why didn't Congress just make it a general law applying to anyone in her situation?? Right now it reads like a totally unconstitutional bill of attainder.

It's not a Bill of Attainder. It does not find her guilty of anything nor punish her. It's no different than any other legislation directed at a single person -- for instance the awarding of a Congressional Medal of Honor.

What specifically about it makes you think it is unconstitutional?

The Republicans wanted that, but time was a wasting and they had to try for this.

If all else fails, can W issue an Executive Order? If Clinton and other past Presidents can issue last minute pardons for criminals, why couldn't Bush do this for Terri?

It's more than just saving a single life - if indeed she was allowed to starve to death, it would set a dangerous precedent - hearsay would become sufficient for yanking someone off life support. Mrs. Schiavo left no will, no written instructions, etc. - all we have is the word of her husband that the plug should be pulled. How many other "inconvenient" people would find their plug pulled if this precedent would be allowed to stand?

What I don't support is the eagerness for overwhelming federal intrusion into a state issue, as long as it's for "our" causes. I refuse to make anything and everything a federal issue; the Constitution provides for enumerated powers, and that's all.

The issue is whether her husband has the ultimate responsibility to convey her wishes; that's a state issue. Even the Supreme Court recognized there are limits to federal authority, for once.
