I'm up too, and very worried (as usual). If nic's right and the whole case is de novo, and even discovery will start afresh, Michael Schiavo must be beside himself. Terri is still his property, Greer is still insane, and now Michael is p----d. What if Greer just ignores this new development and lets them proceed with killing? She needs to be out of Michael Schiavo's reach. It could take a long time for a new judge to appoint a guardian and decide to get her out of hospice. The temptation on Felos/Shiavo/Greer to make the case moot, must be overwhelming now.

I am worried. What happened with the ambulances at hospice earlier tonight? Is anyone there at vigil?

Nope...I am hoping for that too...I am watching LKL now, the repeat of when David Gibbs and the Schindlers were on and they have been playing clips of loser Schiavo and he is such a damn liar (ala Scott Peterson). He had the nerve to say that Terri's parents asked for $$$$ when the settlement happened, he made it sound like he was the one caring about Terri and her dad just wanted money. When LK asked them about the clip they said that they asked him for the money to pay for Terri's care, they wanted to know where the money was! No doubt, Schiavo was spreading the wealth to his attorney, judge and whoever he needed to write a report about Terri the way he wanted it to be...but no money for Terri's therapies etc....

Interesting...someone called and asked if there was a police investigation done as to Terri's original accident and the Schindlers said that on the report of the police that night they wrote "recommend to Homicide" and the Schindlers also tried to file a report but nothing was ever done. Word has it that Michael is buddies with a high ranking police official. I am telling you guys, there is way more to this story....it is not credible for Michael to say (when asked why he doesn't relinquish his guardianship to the Schindlers) its because he promised Terri he'd honor her wishes, when he didn't even honor the marriage vows...how could a judge take this person's word over that of people that brought her into this world??? My take is that settlement money talks....it wouldn't be the FIRST judge on the take I am sure!

well of course MS has buddies who are LEOs there! He works for the freakin sheriff's dept! They probably hate the Schindlers... and from the way they were treating people at the vigil, their alliance shows through.

News on Atl. radio station carrying Art Bell just said Tampa Fed. judge waiting up to receive Bill so that he can order her move to hospital. Aaarrggghhhh...why so slow?

If he waits up for nothing, he will be mad to start with.

De Novo is also my understanding...because a federal district court hears new cases (it is a trial court) and an appeal would go to the Court of Appeals. So in DeNovo, it would be a new trial since Terri has never had legal counsel before. She will exercise her 14th amendment right for the first time. A new claim will be filed on her behalf.

FOX was not all bad. One anchor girl, Carol something, was really putting it to Susan Estrich when Estrich was trying to attack Randall Terry or Terry Randall for his abortion stand. Carol was good at bringing out all the questions about Greer, etc.

Then they went to re-runs...re-runs of bad shows is double bad.

The purpose of the bill passed tonight was to remove the case out of the clutches of Greer. It is going to, I believe, the District Court in Atlanta GA. Imagine the wonderful new case that Terri's lawyers could bring...I bet Mikey is s*itting in his diapers! This could open a can of worms he don't want...if they find sufficient circumstantial evidence when they open all the records this could start a criminal investigation and/or civil suit for wrongful death. (I know I should be doing homework, however, I am in legal studies so I say this constitutes a study of law)
