I'm so torn. I hate the feds sticking their nose in. And I think you're right.

But, I'd give just about anything to see this tried de novo.

I believe that this IS a federal issue - the right to LIFE, liberty and pursuit of happiness. I have no problem with them steepping in. Now if they would do so on the 1st, 2nd amendments and property rights.

I think the difference here is that this is such an unusual and profound situation, 'extraordinary' would be the best term, where the law has proven to be incapable of providing definitive justice, and in fact there is a substantial belief that a mammoth injustice is taking place, that is depriving an innocent victim of the basic human right to life. When the judicial system so completely fails in protecting the constitutional right to life, then it would seem appropriate for Congress to consider the issue.
