Terri's husband isn't the enemy, guardian says

Wolfson's report is based on court files, depositions, medical records and interviews with everyone involved.

That said, I begin with the most explosive allegation:

Did Michael try to kill Terri?

Wolfson laughs. "No!"

Wolfson's report states that in the four years after her collapse, Michael "had insistently held to the premise that Theresa could recover and the evidence is incontrovertible that he gave his heart and soul to her treatment and care . . . In late autumn of 1990, following months of therapy and testing and formal diagnoses of persistent vegetative state with no evidence of improvement, Michael took Theresa to California, where she received an experimental thalamic stimulator implant in her brain. Michael remained in California caring for Theresa during a period of several months."

Says Wolfson now: "Michael was adoring of her. One nursing home complained he was hostile and abusive of the staff in championing her care. She was immaculately kept. In 13 years, she never had one bedsore."

She's had a gob of tests, that's for sure.

But I keep hearing it repeated like an article of faith that she hasn't had an MRI. I would love to know she's had one because I would feel more comfortable with the diagnosis PVS.

Everyday, people decide who lives and dies. I was reminded of this when I was watching an episode of the show "HOUSE" last week that when patients need organ transplants it's just a bunch of Dr.'s and administrators deciding who gets the organs and who doesn't. And somebody can be left to die because of the fact they smoke, or drink or somebody thinks their lifestyle is wrong. But it's human beings making life and death decisions for other people. Why has this case gone this far? I think that has more to do with the political agenda of the pro-lifers. It's an easy one for them because they're able to demonize someone. My sympathies are with Michael Schiavo.

Over a procedural law giving jurisdiction to the federal court to adjudicate how existing law applies to the matter in controversy? I just don't see it. Do you recall what the argument of the attorneys was?

Having said that, I don't really see a different outcome in federal court, unless they try the matter de novo. I guess that is an important point. But one would assume not if it is going to federal appellate court. But I am not clear on that one.

I agree. The way this case has unfolded, I do not want it to set the precedent by which future cases are decided.

Precedence RULES and no side should be content with how this case has been handled.

Man, DeLay's getting personal; he should NOT do that.

They were attorneys on Fox who have seen all the evidence over the years.

And the argument that was made is that it HAS been adjudicated (by more than one court) and he has a right to go with an emergency writ straight to the USSC.

According to federal law, a brain-dead body is legally dead. The 1987 Uniform Anatomical Gift Act, which governs organ transplants, allows research on brain-dead patients. But although this kind of research is legal, it is still unregulated.

I think it's agenda driven too. And perhaps her parents and anger and $$.

I would haunt someone who did this to me. And I would WANT my husband to go on and make a life for himself. He was a young man, for goodness sake.

I've just discovered where the middle aged and older single folks go here in town to meet each other. It's an upscale bar off an upscale restaurant. I've told my husband if something happens to me, wait 6 months and then start going there. He's older than me by 13 years so it's unlikely I'll go first, but you never know and I want to make sure he knows, he is NOT to sit around and feel sorry for himself.

Does anyone know if Terri had an MRI?

I know she's had tons of neurological tests, despite the freepers who keep spreading misinformation that she didn't have much testing.

Terri had a guardian ad litem; it wasn't up to Michael to determine whether Terri had an MRI or not.

And he didn't strangle her, for goodness sake. She had a heart attack, brought on by bulimia. She's been examined by a gazillion doctors.
