I agree. States trump the Feds on most issues. I think DeLay is correct on most issues, but not on this one.

The judge is a liberal scum, but nevertheless, it would seem the Tenth Amendment to the Constitution would predominate here - The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.
