DeLay Pledges Contempt Charge for Terri Judge

House Majority Leader Tom DeLay pledged Friday to hold Florida state judge George Greer in contempt of Congress for ignoring a congressional subpoena for Terri Schiavo's testimony, saying, "No little judge sitting in a state district court in Florida is going to usurp the authority of Congress."

"The Congress will pursue this, if we have to hold him in contempt of Congress," DeLay told radio host Sean Hannity.

Pressed on whether he intended to hold Judge Greer in contempt, the top Republican told Hannity: "Absolutely, absolutely."

"We will do everything to enforce the power and authority of the Congress and no little judge sitting in a state district court in Florida is going to usurp the authority of Congress," he added.

Earlier in the day Judge Greer rebuffed the Schiavo subpoena, telling attorneys in the case, "I have had no cogent reason why the [congressional] committee should intervene." He claimed that the last-minute action on the part of Congress does not nullify years of legal proceedings.

But DeLay told Hannity, "This judge and the Supreme Court of Florida are well known to be liberal judges that have a different worldview and they're imposing their worldview on the law."

The top House leader said that "no sane person" could look at Schiavo and say she's in a persistent vegetative state.

DeLay called a lawyer for Michael Schiavo, who has pressed for years to have his wife starved to death, "the personification of evil."

Sometimes Congress requests your presence at a hearing. Only a fool refuses. If you are an officer or employee of the government, you can be subjected to fine and imprisonment for refusing to appear.

As of the moment the subpoena was issued, I believe that Terri Schiavo became a Federal witness. Judge Greer has ordered action that will lead to the imminent death of this federal witness. My understanding is that that all efforts must be taken to keep the witness alive and unharmed until such time as she is dismissed as a witness or her situation is otherwise legally altered.

What I don't understand is why this witness is not at this moment in the custody of federal marshals charged with keeping her from harm. I also don't understand why federal marshals have not arrested this S.O.B. Greer for ordering that this witness be put to death. I feel certain that he will suffer some sanctions and political consequences for telling the HofR to go suck it up but that's for later

You don't know what you're talking about. The Florida Apppeals Court agrees with me. MS is conflicted. It would help if you read some of the opinions before opining on them Deacon.

Seems the legal eagles claim Terri has been given due process and that judge has not yet had the opportunity, and requiring his to oversee his sentence just might cause him a change of heart and mind.

How does Schiavo have a common law wife?



Does FL recognize common law marriages?.... I read somewhere they didn't thus no common law wife.

Florida law explicitly allows guardians to file for divorce on behalf of disabled wards

Then, why didn't the Schindlers get a guardian who would do this? What kind of attorneys have these people had, if the law provides for this?

Why don't they do it now? Are they forced to use "cause" lawyers who will work for free?

I thought the Supremes already ruled on this? They're going to swat this request away like a fly.

I'm not sure they ruled on it. They refused to hear an appeal regarding the fact that this was a matter of state law, not federal law.

That's not to say that that they couldn't ultimately get involved. But we already have a clue as to how they might rule.

I enjoy reading your informative posts. We need our representatives to break new ground and afford the same rights to the disabled and handicapped and most of all for woman who has a too eager husband willing to pull her feeding tubes without her written and notarized consent as they would cold-blooded murderers and it seems terrorist scum.

Once more a majority of the sheeple display that they hardly bother to THINK (and there ARE legal circumstances under which husband can be deprived of the power, and IMHO and the HO of many in the know, this should have happened to the hino years ago were it not for the good ole boys).

You CAN be, but it is up to a judge to decide whether you WILL be. Congress makes the laws. It is up to the other branches of government to enforce them. Congress cannot force themselves into the individual lives of the citizenry.

Oregon state bar went after a lawyer who used the DA"s office photocopier to produce his affidavit in support of the Swift Vets,why can't the Florida State Bar go after Felos for disregarding a US Congress subpoena and counselling his client against obeying the same.

Excellent question. No clue about the answer, though. :)

Who tried to kill her? Who has extreme conflicts of interest? AND ON AND ON? That's like saying a child molester foster father should decide on whether the molested child continues to live with him.

Can you prove any of that?
Prove it in a court of law?

And some of them feel even an adulterous, lying husband who hates his wife should have full control over her. What perverted arguments. No, a wife is not a husband's property. In the Sunny von Bulow case, the courts stated that her children, not her husband, would be her guardian. And Sunny is still kept alive, no one is making a fuss, even though she is far worse off than Terri.

I read your appeals' court blurb. What it says is that Michael is empowered to give the courts authority to act.

Did you get that? Michael made the decision!

The courts consider spouses to be one, and one spouse can make a decision for the other, unless a directive exists otherwise.

If the Florida Appeals Court agrees with you, why are we where we are today?

I am unsure if anything will be done to George W. Greer by Tom DeLay. I lack confidence in this subpoena caper working out in the long run.
