Judge Dismisses 'Fowl' Noise Petition

FRANKLIN, Tenn. - Four roosters have something new to crow about. A Williamson County judge dismissed a civil petition by Richard Milardo that sought to force his neighbors to get rid of their roosters because they disturbed his peace by crowing throughout the day.
"I know how annoying things can be to people, but I really don't believe there is anything I can do," General Sessions Court Judge Al Nations said at a hearing on Monday.
The neighbors, Jon Jackson and Kimberly Roberts, said they were pleased by the ruling.
"If he took away our roosters, then he'd have to take away every rooster in this county," Roberts said.
The couple also have hens, turkeys, donkeys, geese, swans and dogs on their 2 acres of property just outside Fairview.
Milardo said he didn't have the money to hire a lawyer to appeal the judge's ruling.
"In other news, four roosters disappeared early this morning. There are no suspects in custody, but some neighbors are suspects after police visited a neighborhood party where four roasted chickens were the featured meal. More news at 11."
In Tennessee, that's fried chicken.

Sounds like so far folks would "solve" the problem by stealing/eating the roosters. These folks are outside town; they can keep roosters if they want to. Thank goodness at least one judge still respects that property right.
I'd be interested to know how long Milardo has lived there. He sounds like one of those people who buy a house near an airport and then complain about aircraft noise. Perhaps he should have stayed in town.
Very similar to a thought I had, moving out by a turkey farm and then complaining about the smell.
(I left it out of the previous post because where I come from, most of the folks were there before the obnoxious turkey farms, and I have great sympathy for those who have to smell the new . . . endeavor.)
