A little nip of NyQuil has landed former Santa Clara County Judge William Danser back in the county lockup.
Danser was ordered last summer to stay away from alcohol as one of the terms he agreed to in exchange for serving his 90-day sentence under house arrest instead of jail after being convicted of fixing traffic tickets for friends and pro athletes. But on March 4, Danser took over-the-counter cough remedy without notifying his probation officer, according to his attorney and the county Probation Department.
NyQuil contains alcohol, traces of which showed up Tuesday in the latest test results of a urine sample taken March 4 during a surprise 9:30 p.m. visit to his home by a probation officer. After a probation hearing Wednesday, a judge ordered Danser back to jail to serve the remainder of the 90-day term in custody.
``He didn't violate probation, he violated the terms of his electronic monitoring. For that, there are no sanctions other than being returned to jail,'' said Delores Namm, a spokeswoman for the probation department.
Had Danser's bad cough struck just eight days later, he wouldn't have been ordered back to jail for quaffing NyQuil. At midnight on Saturday, his 90-day term is over, along with the restriction on his alcohol use, Namm said. Danser will be released from custody at that time.
Danser was also ordered to serve 400 hours of community service as part of his ticket-fixing sentence.
Danser's lawyer, Kenneth Robinson, said the former judge simply ``forgot'' to tell his probation officer that he had a bad cough and was going to need to take NyQuil. The alcohol-containing product was listed by name in the terms of Danser's electronic monitoring agreement as prohibited to Danser unless he notified the probation official, Robinson said.

He also needs to stay away from chocolate candy that contains liquor.
And don't forget to keep the vanilla extract locked up.
I have to avoid alcohol due to a medication I take - we really have to scan the labels to find something when I get a cold! Fortunately, Robitussin makes a line of alcohol-free formulas.
I'm not interested enough in this to check labels but how much Nyquil would one have to "drink" to show a significant alcohol blood level?
Not sure, but I know that Nyquil is 10% alcohol.
I can't remember why NyQuil. A six of NyQuil has got to be more expensive than 1.75liter of some no-name vokda.
Anyway, in areas that don't have alcohol available on Sundays, you'll notice NyQuil types of products are kept
at the back to make it harder for the bums to rush in and grab the products.
One of my alcoholic in-laws drank my vanilla extract once.

That's all a crooked judge gets for perverting our justice system. He betrayed our trust. He played on our fears. (Oh yeah, that was refering to someone else.)

No, it was Spice Islands brand bourbon vanilla extract. I don't remember what the alcohol content was, but the generic brand of "100% pure vanilla extract" I have now is 35% (70 proof.) I use quotation marks, because when I read the fine print, I discovered it's cut with corn syrup, in spite of the large print claim of 100% purity. It's as pure as Madonna; not to be confused with The Madonna.
I've seen winos in grocery stores grabbing extracts off the shelf and drinking them as fast as they could. If you have to have it that's one quick way to increase your BAL.
