Casino Stands Firm On Firing Waitresses Who Gain Weight

ATLANTIC CITY, N.J. -- The battle over bulge continues at an Atlantic City casino.

The "Borgata Babes" aren't getting a break on their weight. The Borgata Hotel Casino and Spa in Atlantic City, N.J., won't budge on its new weight requirements.

The Borgata has rejected a union grievance challenging the casino's imposition of weight limits on cocktail servers -- known as "Borgata Babes" -- and costumed bartenders. It said they are performers whose personal appearance and grooming are a key part of Borgata's image.

The babes have to squeeze into skimpy costumes.

Last month casino officials announced that the Borgata Babes and bartenders would have to weigh-in. Anyone who gained more than 7 percent of their body weight would be subject to suspension or firing.

But Local 54 of the Hotel Employees and Restaurant Employees union, which represents the cocktail servers and the bartenders, quickly contested the policy. They said it violates the casino's contract with the union by imposing a unilateral change in working conditions.

Officials of the waitress and bartenders union said they'll now take the weighty issue to arbitration.

I don't think the union has a leg to stand on especially if the casino made the rule clear when they hired the employee.The Mohegan Sun Casino in Connecticut has all different shapes and sizes serving drinks in their Pocahontas outfits.I don't really care what they look like as long as I get good service.

I agree with the company, too. They have an image they want to present, and they as the employer get to say who does and who doesn't fit that image, and they are requiring it of the women and the men.

The article say it was a new policy so it was probably implemented after a bargaining contract was already in place. I think the Union has a strong case here.

Even though I agree with the employer on this one, as a smoker, I can definitely see your point, especially in light of the company I've heard about who is requiring their employees to quit or get fired. But then if that is going to apply to smokers it should also apply to overeaters and drinkers, as their habits are unhealthy also.

Unless the employer is allowed to determine the restrictions we will have the state designating who is allowed to work for whom.

Sorry, but you are too pretty to work as an engineer. The services industry needs pretty girls.

That sounds like its an attempt to impose a new condition of employment on an already existing contract.
So long as this rule was in the contract from the start and its existence was made clear to employees when they were hired I've got no problem with it.

I wouldn't mind a weight restriction if it applies to all employees.

Any 290 pound tub of lard manager telling me I'm in trouble for gaining 11 pounds is in for some serious grief.

Actually they are whatever the company who hires thems is PAYING them to be.

If the Casino is hiring them to enhance the attractiveness of their gambling environment they have the right to do so.

The women are working to make a living. They have a NEED to do so. Attractiveness is in the eye of the beholder. The rent to pay and the children to dress up and send to school are objective realities.

As morality is about choices... well what's more important?

Many things you say are true, but this is the real world.

You can lecture all you want on what is or isn't "moral".
But somebody like Whoopie Goldberg is NEVER going to be hired to pose for Sports Illustrated swimsuit issue.

Fat unattractive people are not going to be allowed to wear sexy Borgata waitress outfits and serve drinks to their patrons. It's not going to happen.
