Schindler Family: Terri's Judge 'Afraid of the Truth'

(CNSNews.com) - The family of Terri Schindler Schiavo says the judge who ordered her starvation and dehydration -- a process that will begin on March 18 unless a higher court intervenes -- is "afraid of the truth," and is denying Terri's due process rights under state and federal law.

"Never in my life have I seen a judge so afraid of the truth," said Pamela Hennessy, media representative for the Terri Schindler Schiavo Foundation in a statement Tuesday morning.

"Why is it that admitted criminals are protected to every reasonable measure of the law," Hennessy asked, "while our disabled and vulnerable citizens are discarded by the courts as unworthy?"

The Schindler family is angry that Pinellas-Pasco County, Fla., Circuit Judge George Greer refused to hold a hearing before denying more than half of the 15 motions the family filed Monday. According to Schindler family attorney David Gibbs III, Greer would only agree to entertain motions that are related to Terri's planned death.

The foundation called Greer's action "reprehensible and a clear denial of the due process rights afforded to Terri Schiavo under federal and Florida law." The group is particularly outraged that Greer has not removed Michael Schiavo as Terri's guardian for what they see as clear violations of the state's guardianship laws.

Hennessy's statement accused Schiavo of:

Spending the money awarded to Terri for rehabilitation and therapy on his legal expenses,

Denying Terri necessary medical treatment and services,

Living in open adultery with a woman, by whom he has fathered two children, and

Failure to file timely guardianship reports and complete mandatory guardianship training.

George Felos, a noted advocate of the so-called "right-to-die" movement and Michael Schiavo's attorney, has repeatedly denied that Schiavo has violated any laws. He blasted the Schindler family on Monday, saying that Terri's parents were "going to try anything, including throwing in the kitchen sink," to prevent their daughter's death by dehydration and starvation.

Schiavo has claimed that Terri expressed a desire not to be kept alive by artificial means should she ever be debilitated by an accident or illness. His brother and sister-in-law corroborated that assertion, which Greer accepted as "clear and convincing evidence" of Terri's wishes.

But Terri's biological relatives, co-workers, friends and fellow church members universally dispute the claim, noting that she was extremely upset when the family of Karen Ann Quinlan disconnected the respirator that had been keeping the comatose woman alive, with the help of the New Jersey Supreme Court.

The Quinlan case differs from Terri's in that there was complete consensus in the medical community that Quinlan could never recover and her entire family was in agreement that she would want to be allowed to die.

Judge Greer is prohibited by the Florida Code of Judicial Conduct from responding to media inquiries about his handling of Terri's case while it is still pending before him.

Tough words said about a sitting judge. I have to disagree about the treatment of our disabled and vulnerable citizens. We have to decide whether we want a law or not, many of us face such issues when we vote.

Usually judges are appointed for life but there are ways to have a judge answer questions if his rulings were not based on the law.

This tragedy gets sadder by the minute. One can wonder if Terri is able to understand events around her what she must be thinking of both sides of the issue.

I somewhat hope she isn't, to watch her parents and husband go down this ugly path is tough for those of us who are not hands on with this case.

Is anyone else thinking of flying to Florida to stand vigil if this happens? I cannot stand by and watch .... If it's not time for 50,000 in the streets, what is???????? Maybe a meeting in the DC Mall.

Did you read the recent news about the study that was done on brain damaged patients that detailed they are aware and understand what's going on?

Terri goes Goo~Goo eyes over Attorney Gibbs

Last night at hospice Terri's father, Robert Schindler and Attorney Gibbs visited with Terri. Mr. Schindler was the first to enter Terri's room, approaching Terri on her right. As always, Terri was delighted to see her Dad until Mr. Schindler announced that Mr. Gibbs was with him.

Mr. Gibbs moved closer to Terri's left greeting her with, "Hello Terri."

Terri, hearing Mr. Gibb's deep voice immediately turned to her left to look at him. Terri's Dad stated that once she eyed Mr. Gibbs that was the end of his visit with her because she was no longer interested in anything he had to say to her..."she was goo-goo eyes over Attorney Gibbs."

Mr. Schindler then exclaimed, "Terri, Terri, look at me. I've come here to see you as well and now you cannot take your eyes off of Attorney Gibbs, what am I chopped liver?" Terri responded with laughter to her father's comment but her eyes remained focused on Mr. Gibbs.

Bob said,"Well, Cheryl that's the last time I will be taking Mr. Gibbs along with me since my daughter did not hear anything I had to say once he had her attention."

Just had my teen watch this and I asked...Did you hear Terri laugh? the reply was "I'm not deaf".

If Terri were Karen Ann Quinlan and she suddenly as aware as Terri is, everyone would think it was a miracle!

I Pray for Terri and her family and I believe that the parents are on the right track!

I know that I have said at different times over the years should X or z or y happen to me pull the plug. But did I really mean it? I think in the end I would cling to life for all that it was worth and as hard as I could and I believe that Terri is doing just that and that all of our prayers can help, and hey, maybe even she can sense it. Different senses have to be in play for her that we, my friends, just have not developed.

Terri does this, Terri does that. Terri laughs. Terri is delighted.
OK. OK. Does anyone in the Schindler family have a video cam? Or is this just a lot of hype? I'd say a video of Terri's movements, facial expressions and actions on a daily basis would go a long way to win support.
In reality, these 'stories' are just that, 'Stories'. Fantasy at it's best.
Prove all the medical and legal world wrong... Produce video! My gut feeling is, that's not going to happen unless it comes from 'DreamWorks Animation Studios'.

Meanwhile in Iraq... 'suicide bombing site where according to official figures 127 killed, 124 injured in attack Monday claimed by Al Qaeda in Iraq. Mass funerals took place in Najef.

The Advocacy Center for the Disabled received reports of abuse/neglect. They have had the info for over a year. Richard Labelle, of the Advocacy center, told a reporter they could not complete their investigation because Michael Schiavo would not give the examiner access to Terri.

What good does it do to have an agency to protect and serve the disabled if they are blocked from doing their job?

MS won't allow anyone to take a picture of Terri, won't allow her outside, and she is subject to no pictures or sensory stimuli except for the list of "approved visitors". If the public were to see Terri things would probably be much different. The media just seems to report the same thing over and over.

You seem to be inquisitive. Please go to www.theempirejournal.com and read some of the articles there. DCF intentionally covered up the first investigation. The AHCA did not follow through, one of these agencies actually had the nerve to ask the complainant to return any correspondence received from them. Those docs are safe though. There is major trouble and corruption going on and I think that we'll learn of a lot more of it before all is said and done.

I, too, am praying for this dear lady. I cannot bear to think of forced deydration.

I was at the side of both my father-in-law and my mother when they died from cancer and saw that while they did not fear death, nor cling to life at that point, both had a strong desire for water. My father-in-law could barely speak he was so weak, but he did say one word several times, "water" in his mother tongue. My mother was lucid and not in pain but stated that she had never been so thirsty before.

How could anyone deny water to another person?

No, he is afraid, in fact he knows, that if Terri is not murdered some movers and shakers in Pinellas County will end up disbarred and in state prison for the crimes that have been committed upon Terri.

For the guilty to prosper, the innocebnt must be put to death.

I know exactly what's going on. Take those words to means anything you can imagine. Beyond that, I offer that I, too, think that Terri's guardianship should be turned over to her parents. Not because MS may or may not be trying to hide something or may or may not be in it for the money (although it's all spent), BUT because who, beyond Hospice, will take care of Terri? Her parents? 24/7? Are all the Terri supporters going to take turns nursing her at each others home? Has any supporter established a fund to facilitate such monetary support required to care for Terri? Where is the plan outlined to care for Terri should MS give up? What happens when her parents are gone. (Physically Terri could out last them, and at best taking care of Terri daily will take an enormous toll on their longevity). I don't see any plan, except that of verbally bullying the public into believing that the medical and legal community is out to 'murder' Terri (as her father calls it).

I am praying, also, that the Common Law Wife will not be able to sleep at night because of this. That she will be tormented until SHE comes forward. It was one thing ten years ago and MS was talking all sweet about 'what Terri wants' but now he is like Captain Ahab. Surely she sees it. Surely the children see it. I'm praying that the children will speak out, as well.

I don't know the answers to all your questions. I seem to recall reading something that Terri's brother would become her guardian. In a recent article Mr. Schindler was quoted that there are doctors who have offered to care for her at no charge, provide services etc is what I took that to mean.

Terri is in a hospice-meant for the dying.

She is not dying, but she is about to be killed, horribly, I might add.

Her parents love her.

Her husband, who lives with his mistress and has fathered two children with, states that Terri would not want him to be lonely.

But he sure as hell has not cared that Terri is imprisoned in a death house where she is NOT ALLOWED, because of her husband's rules, to have flowers, pictures, go on outings outside the room she suffers in, is NOT ALLOWED ANY THERAPY for her long since atrophyed muscles (has not had THERAPY for 12 years).

MEDICAID is paying the terrific bill for the hospice stay (four years now).

Why?

Because her husband, who lives with his concubine in an upscale house, complete with not one but TWO MERCEDES, a van, a huge swimming pool, you name it, has said he can no longer afford it..ad the corrupt Judge Greer agreed.....even tho MICHAEL STOPPED ALL THERAPY FOR TERRI IMMEDIATELY AFTER HE WAS AWARDED 1.2 MILLION DOLLARS BY A JURY DESIGNATED TO CARE FOR HER....he used the money to hire lawyers to help him kill her.....so the TAXPAYERS, you and me, get to pay for Terri when her parents want to take her home, wrap her in love, offer her therapy and minister to her needs.

Guess Michael Shiavo is entitled to joy but Terri is trash, left in a void room in a place where people with less than six months to live go, waiting endless hours for a visit from her parents...when...that is..Michael says they can visit.

You see....he can control EVERYTHING while he pants for her death, just like he used to check her car odometer to make sure she had not driven anywhere but where he deemed ok.
