Terri Schiavo's parents ask judge to let her divorce husband

TAMPA, Fla. - Terri Schiavo's parents asked a Pinellas court judge Monday to allow her to divorce her husband - in either life or death - in a court filing accusing Michael Schiavo of adultery and not acting in his wife's best interests.

The filing was one of a flurry of 15 motions filed by Bob and Mary Schindler as they now have less than three weeks to find a legal way to keep their severely brain-damaged daughter alive.

Terri Schiavo is scheduled to have the feeding tube that has kept her alive for 15 years removed March 18 unless her parents can convince an appeals court to block Michael Schiavo again. Michael Schiavo says he will have the tube pulled because his wife once told him she would never want to be kept alive artificially.

David Gibbs, the Schindler's attorney, said Pinellas Circuit Court Judge George Greer has indicated he will not hear the divorce request and five other motions filed Monday - but that only means that the matters are now on their way to being appealed to the 2nd District Court of Appeal in Lakeland........

If someone does this to you or me, I sure won't see them in heaven.

That's why I have to thank this woman (Terri) for making me take the steps to make a living will. To give permission to let me go.
I want to die with some dignity.....I don't want to be fed and wiped and changed by nurses on the backs of taxpayers all to ease someones guilt of letting me go.

I made it legal to let me go without guilt. SO they can rest easy and look forward to going to heaven.

And look at the money I saved you. You're welcome.

The church allowed an annulment in my marriage, against my will, and we didn't have a civil divorce. This was in the late 70s, early 80s.

Are you sure? I worked in a marriage tribunal from 1985-1996, and we never took a case that had not first obtained a civil divorce. It's a Church regulation, meant to prevent alienation-of-affection lawsuits.

I was over reading the thread about Texas and Medicaid and Andysandmikesmom said this about Medicaid. It could account for what Felos said that there was about $60,000 left in the bank.

Its my understanding that when its a married couple and only one needs the nursing home, then the spouse on the outside is allowed to keep their home, one vehicle, and up to 60K in assets...

It's amazing that you think you understand the legal system. If someone's guardian is not acting in their interest, the relationship is severed. If Terri was an 8 year old and her father was a crack addict, her grandparents could petition for custody. Since Terri is non compis mentis at this time, the principle here is the same.

No offense taken. I'm glad you posted this, because in the back of my mind I was thinking that family law could also come into play here. The guardian for Terri is not only neglecting his duties, but acting directly against her best interests. The law is strict in these cases. I'm just wondering why it's taken DCF so long to do their job.

If only the sceptics here would bother to read all the information for themselves, before coming on these threads and being rude.

This plus the fact that any sane person would want a divorce from an abusive spouse, tells me exactly what Terri would want. Thanks for reposting this info.

A Dr. explained it on the news...her sensation for hunger does not exist..

Not according to one of the experts that I heard. He said he would be VERY uncomfortable assuming she can feel nothing. Why is it too much to err on the side of caution?

...and she would be given more drugs for any pain she might be experiencing as with anyother patient.

IIRC, the last time they tried to kill her, she was not allowed any drugs for pain.

This is so cruel in my opinion to keep this woman alive without a shred of dignity (probably against her will)

You have no idea if she wants to die. Neither does anyone else. From all we can see, she does NOT want to die. She has been trying to stay alive through all the neglect that has been heaped on her for 14 years.

I think it's horrible.

What's horrible is that she has not had ANY rehabilitation in 14 years or so, not since the insurance payout which was supposed to go for her care, but now is used for other things than what it was intended for. If this isn't insurance fraud, at the very least, I don't know what.

I am sure that the doctor on the TV was going by the wrong info that Terri is PVS (which she is not)

Terri is probably alive now due to the lack of pain medication she received at her last starving. Morphine slows the rate and quality of respiration, inducing acidosis and leading to a quicker death.

During my Dad's last stay in the hospital (which originally was to be for only four days) he had to beg for pain meds for his arthritis. They allowed him only Tylenol and an occasional Vicodin. After he contracted numerous nosocomial infections to the point he could not survive, the physicians were more than willing to treat his pain and hasten his retreat from this life with Morphine. I believe his error was in telling his doc he was going to be cremated. The care went downhill after that.

My bet is that Terri will get pain meds this time if it is allowed to occur.

There is definitely something or someone motivating this guy. He seems to be reacting out of intense fear. I would like to see an audit of his finances.

You know what I think, Greer needs to go down and watch Terri die of starvation and see if she feels the pain or not. I think he needs to sit the whole time and watch her struggle for food or water. But of course he won't, cause he knows it will be a horrible site!
