Terri Schiavo's parents ask judge to let her divorce husband

TAMPA, Fla. - Terri Schiavo's parents asked a Pinellas court judge Monday to allow her to divorce her husband - in either life or death - in a court filing accusing Michael Schiavo of adultery and not acting in his wife's best interests.

The filing was one of a flurry of 15 motions filed by Bob and Mary Schindler as they now have less than three weeks to find a legal way to keep their severely brain-damaged daughter alive.

Terri Schiavo is scheduled to have the feeding tube that has kept her alive for 15 years removed March 18 unless her parents can convince an appeals court to block Michael Schiavo again. Michael Schiavo says he will have the tube pulled because his wife once told him she would never want to be kept alive artificially.

David Gibbs, the Schindler's attorney, said Pinellas Circuit Court Judge George Greer has indicated he will not hear the divorce request and five other motions filed Monday - but that only means that the matters are now on their way to being appealed to the 2nd District Court of Appeal in Lakeland........

Your post is so complete, organized and covers so much of the Terri story. Excellent synopsis for someone who needs to learn more facts about this case but has little time.

Unfortunately, Terri's parents couldn't get her to another state without being charged with kidnapping.

So? I'd do it for my child rather than let them be tortured for years. And I'd do it for Terri now if I was there.

This really bothers me. Medicare is taxpayer funded. Why are they paying hospice care for a woman NOT terminally ill, for years?
Especially when the husband has hundreds of thousands of dollars, if not more.

He recently told Randall Terry to get off HIS property.

Why is this not investigated? And why is not that crooked Judge Greer not investigated? He has rubber stamped everything that MS ever wanted.

And the issue he makes of those of us who distribute the video of her responding (like FL-engineer) that we are insensitive exploiters. Well, if that isn't the pot calling the kettle black.

Speaking of insensitive, on that program, Michael Schiavo, who was so concerned about Terri's privacy, and for all who are being exploiters, made a comment, on Larry King's program, about the "foul smell between her legs." How's that for privacy and sensitivity concerning Terri?

Hey, if you can find a legal precedent for divorce by proxy, anywhere in the USA, we'd all love to hear it. It's a legally bogus motion.

Not to be nitnoy, but "by proxy" means by a designated representative/agent. If Terri is divorced it would be more like a petition to sever parental rights: Schiavo is an unfit guardian because he has vacated the spousal role (in spades!) and so the Schindler's are petitioning he get his butt out.

He knows Terri can swallow; everyone knows Terri can swallow. he just doesn't want people to realize she's been swallowing her own saliva for the past 15 years....and, therefore, has a capability of swallowing more than that.

Right. And water on her tongue and mucous membranes would certainly ease the pain of dehydration, but for some reason Michael believes he has the right to deny even pallative care if such care might prolong his victim's life.

If she has a known choking problem with a corresponding nursing care plan, is given food not indicated on the plan and developes an aspiration pneumonia (usually indicated per Xray), then this will have to be investigated and there is likelihood licensing agencies will get involved. He is looking out for the facility, and trying to keep his wife away from Federal or State investigators.

test in 10 years. Her teeth were never cleaned in 10 years.
So we're going to have to restore her physically first, and

people think, or are saying that it is.

SCHIAVO: Yes. Terri's had perfect care. She just had her
teeth cleaned three months ago. And to touch on the
gynecological, the gynecologists that took care of her told
me -- and I'm only following what doctors tell me to do --
because it's so hard -- and I'm sorry to be so explicit --
to open her legs. She doesn't open them like you and I would
at a gynecological examine.

KING: You to pry them apart?

SCHIAVO: Yes.

KING: So it's hard to do a gynecological exam?

SCHIAVO: Right. Right. So unless there's blood, or if
there's foul smelling -- I'm sorry to be so explicit, but
that's what it's all about.

In any event, the point is, for someone who pretends to be so concerned about Terri's privacy, he went to great lengths to be disgusting about Terri's private matters.

Believe me, a lot of people have been asking that same question, and not getting a decent answer. She's been in that hospice for 5 years or so, and hospice care is supposed to be limited to 6 months and only for the dying, which she is NOT.
