Terri Schiavo's parents ask judge to let her divorce husband

Associated Press

TAMPA, Fla. - Terri Schiavo's parents asked a Pinellas court judge Monday to allow her to divorce her husband - in either life or death - in a court filing accusing Michael Schiavo of adultery and not acting in his wife's best interests.

The filing was one of a flurry of 15 motions filed by Bob and Mary Schindler as they now have less than three weeks to find a legal way to keep their severely brain-damaged daughter alive.

Terri Schiavo is scheduled to have the feeding tube that has kept her alive for 15 years removed March 18 unless her parents can convince an appeals court to block Michael Schiavo again. Michael Schiavo says he will have the tube pulled because his wife once told him she would never want to be kept alive artificially.

David Gibbs, the Schindler's attorney, said Pinellas Circuit Court Judge George Greer has indicated he will not hear the divorce request and five other motions filed Monday - but that only means that the matters are now on their way to being appealed to the 2nd District Court of Appeal in Lakeland........

I see. It would seem the reasons for Terri desiring divorce would greatly have increased since 1990.

So much so that any reasonable guardian would be able to get a divorce for her without need for any hearsay testimony about pre-1990 efforts to get one.

.The $1.2 million was because, as sociopath Michael claimed to the gullible jury, Terry was going to live a long, long life if he had anything to do with. Basically days after the award was received he inssued a DNR and began to violate all the promises he gave to the moron jury.

I know; and Greer refuses to read the papers and documents in his own Courthouse.

I know you didn't point this to me, but I will throw my two cents in. ;) I don't mean to be argumentative, but apparently it didn't matter at all to the parents when they shacked up and had them in the first place. Michael's girlfriend could have kept from getting pregnant had they not wanted to.

A good deal of what goes on in courtrooms is theater.

Bad theater at that. Unfortunately in some cases, it boils down to who lies best, and can afford the biggest shark. In this case, there is a grave conflict of interest to consider.

An innocent woman's life hangs in the balance. While I don't advocate doing anything illegal, The Schindlers need to pull out all the tricks to save their daughter from a horrible death. If that could happen, I wouldn't care if Schiavo, Greer, and Felos walked away scot-free.

But FL judges permit adultery by a spouse in a "loving" relationship.

After the Court's ruling in Lawrence v. Texas, I don't think any adultery law which provides a criminal penalty can be enforced.

Presumably it can still be statutory grounds for a divorce, but I'm not sure how many states haven't essentially adopted a "no-fault" divorce law anyway.

If I recall, the parents were hoping that Michael would move on in his life, and if he met someone, were hopeful that he'd want to divorce Terri so he could get remarried.

Are you aware of a shred of evidence that Ms. Schiavo previously made plain her desire for a divorce under these kinds of circumstances?

Actually, Terri's friend, Jackie, and Terri's brother both testified that Terri was going to file for divorce. The night of Terri's "accident", Jackie begged her not to go home but Terri did. Judge Greer refused the testimony as "hearsay". Interesting, isn't it. I guess it depends on whose hearsay it is as to whether Greer likes it and admits it as evidence.

HINO's fiance (co-murderer) is living in a house paid for by Terri's money. Even though the house is in her bame, the tramp doesn't work, and never has.

How can she afford the house she is in and it has a pool/upgrades too!

"Oh, they testified that she would want a divorce if Michael was adulterous? You know better than that."

What does that mean, I "know better than that"? Perhaps you don't have the facts.

It had nothing to do with his affairs -- he was abusive to her. That was the reason.

Terri told a co-worker and a family member that she wanted to divorce her husband.

This was shortly before the "heart attack".

Yep.. he wants to preserve her privacy yet goes on Television and speaks about her menstrual period and how she smells and how hard it is to open her legs. She can't feel or think but imagine her embarassment if people were to see her. Others aren't allowed to help her get better because and even try to eat by mouth because she might die from choking yet he is trying to heinously starve and dehydrate her for the third time.

Now for some truth:

He won't let others try to get her voice back because he is afraid she might want to live.. can't have that.. got to rely on hearsay evidence from couple years before the "incident"/"accident" which he can't get his testimony straight on and which contradicts how she was found on the floor. She had multiple fractures on her body, broken femur, back, etc. from collapsing inside/outside the bathroom with her front half on the carpeted floor. She is 5'3". Michael couldn't remember how she was found on the floor or in what position as he said he remembers that night but when questioned he said she was completely outside the bathroom. Paramedics and Police report contradicts this. Says fell on face and stomach (which is how the paramedics found her on the floor and is in the police report) except for one thing he says that he turned her over. Huh? She was found on her face and stomach by the paramedics.. lie number one. Lie number two .. how did you know she stopped breathing.. I felt her chest .. paramedics found her on her face and stomach.. he felt her back? This guy is guilty and lies in court depositions and testimony. He held her in his arms and he rocked her. She was found on her face and stomach!!! The man perpetrated domestic violence and continues in his attempts to murder his wife. This is criminal and so are the others trying to help him get away with this.

I just heard about that last week; it's absolutely disgusting what Michael has done to Terri.

Yes, The Empire Journal has a slew of information about Greer rulings on other cases, as well as other people coming forward.

Uh oh. That's what I get for assuming. MS's religion hasn't come up, or if it has, I missed it. Is he Catholic or not?

Yes I know she can't get an annulment, but if any marriage needed to be annulled, this is it.
