Evidence that somebody did something at some OTHER time in the past is NOT evidence that someone did the same thing on a particular occasion. There are a few exceptions - habitual action and similar transaction, but they don't apply here.
Wish these folks who don't understand the law would quit pontificating on it. Although I guess they figure if they sound authoritative enough most people won't know the difference.
