Hearing on release of Knight firing report likely to be delayed

BLOOMINGTON, Ind. - A judge likely will delay a hearing set for next week that was to determine whether Indiana University must release a report that led to the firing of former basketball coach Bob Knight, court officials said.
Special Judge Jane Spencer Craney of Morgan County was scheduled to conduct the hearing Wednesday in Monroe Circuit Court. But it might have to be postponed to an unspecified date because of criminal case in her own Morgan Superior Court, court officials said.
Craney was hearing the case because all Monroe County judges recused themselves, IU spokesman Larry MacIntyre said this week.
The defendant in a robbery, burglary and assault case has asked for a speedy trial in Morgan County, The Herald-Times reported Saturday. Unless there is a problem in that case, Craney indicated she would postpone the public-records case at which NCAA President Myles Brand, the former president of Indiana University, was expected to testify.
Brand fired Knight in 2000 for violating a "zero tolerance" behavior policy he imposed after former player Neil Reed accused Knight of choking him at a practice. Brand asked two university trustees to investigate the incident, and The Indianapolis Star filed a Freedom of Information suit to gain access to their report.
Knight, who also sued the university but dropped the suit last year after a Monroe County judge ruled against him, is now the coach at Texas Tech.
Knight was fired after he angrily grabbed the arm of a student who greeted him by his last name. The Star later sued the university after it refused to turn over the documents related to the firing. Craney initially ruled in favor of IU, but the newspaper appealed, and the Indiana Court of Appeals sent the case back to the judge in May 2003.
The appeals court said IU did not have to release a university police investigation of Knight's confrontation with the student but that it might have to turn over the report by trustees Fred Eichhorn and John Walda.
If they were acting as trustees rather than lawyers representing the university, the report would not be confidential under attorney-client privilege, the court said.
MacIntyre said Wednesday's hearing was going to be on that "very specific issue."

I grew up watching IU basketball with RMK. I will not ever root for them again after what Myles Brand did. They've already lost a bunch of money from Knight being gone. Since his departure the athletic department has been in the red. He brought so much money to that University.
