SCO Group faces possible Nasdaq delisting

NEW YORK, Feb 17 (Reuters) - Software company SCO Group Inc. (SCOX.O: Quote, Profile, Research) on Thursday said it may be delisted from the Nasdaq SmallCap market as a result of its failure to file its year-end earnings with the U.S. Securities and Exchange Commission in a timely fashion.

The company said it would request a hearing with Nasdaq to delay the delisting. As of Friday's opening, Nasdaq will add an "E" to the company's ticker symbol.

The company said it has not filed its annual 10-K report with the SEC because it is examining matters related to stock issued as part of its compensation plans.

SCO has sued International Business Machines Corp. (IBM.N: Quote, Profile, Research) for allegedly violating SCO's trade secrets by introducing part of its Unix source code, or software blueprint, into Linux -- a freely available operating system.

I don't particularly like SCO & company, but because of accounting rules changes at the SEC, SCO is not the only company to delay filing their year-end reports.

Hmmmm, could this be related to Darl's pump and dump? Now that the stock's in the toilet, are Darl et. al. trying to reduce their losses through creative accounting?

There is a lawsuit involving the Yarro family and the current SCO/Canopy people. A falling out among thieves, I guess. I am thinking this may have something to do with it, but until SCO releases its paperwork, it's difficult to say.

Big Blue was bad enough, but taking on Novell might prove to be their Waterloo. If they lose the Novell case, they have no standing to sue IBM.

All those folks who bought the stock, not knowing they were buying part of a lawsuit, and specifically the side of the lawsuit that is hinky about discovery...

... there is one born every minute. Microsoft, however, got value for their dollar, even if the chumps who bought into it didn't. Now it's time for every chump who took a flyer on Darl's pump and dump to take a lump....

Darl did very well out of it, himself, which is always what it was about from his point of view.

MS got their money's worth. They backed this to told up Linux which has bought them time to work on LongHorn. My bet is that McBride will end up as the CEO of one of the companies that Microsoft is buying up and he will be set for life. Watch MS. They are buying up small companies for the intellectual property. I see a huge amount of law suits by MS against Linux users alleging copyright infringement.

True, but that could also be said of quite a few companies nowadays. Its just that SCO is more suicidal than most.

Maybe they just couldn't figure out a way to produce a filing that wouldn't be very... interesting... to the SEC.
