Dog helps bag his owner on pot charge

GRAPEVINE Matthew Porter and two friends were playing disc golf at a Grapevine park on Valentine's Day when a police officer approached.
Investigating a strange smell, Officer Cris Brichetto asked the trio for identification.
That's when J.D., Mr. Porter's black Labrador retriever, played a game of fetch his owner won't soon forget. The pooch waded into a nearby creek, retrieved a plastic baggie and brought it to Officer Brichetto.
So much for man's best friend.
Euless resident Micah Hays, 24, was arrested and charged with marijuana possession. Mr. Porter, a 25-year-old Richland Hills resident, was charged with possession of drug paraphernalia.
"It's been kind of a running joke with this whole thing," said Grapevine police Sgt. Todd Dearing. "People have been asking us if we're going to recruit the dog for police work."
The group's third member was not charged and was given custody of J.D.

Jeez, they must have been stoned. If you are in a strange place with your Lab and throw something, odds are it is coming back to you.
Actually I imagine a good defense attorney would argue that there was no way to prove the bag of pot discovered by the dog belonged to the defendents...
Just what I was thinking. There is the whole "fingerprint" issue, though.
How does that lead to probable cause to search these guys, which he must have done to find paraphernalia? Where is the reasonable connection between a baggie in the creek to these men?

He already had the funny smell. Besides, it's also possible that they consented to the search; lots of people are woefully ignorant of their legal rights.
I feel safer.
The distance a man can throw a baggie. Law enforcement people have to find probable cause, they do not have to pretend they were born yesterday.
In the article in the Fort Worth Star Telegram, Hays admitted to owning the marijuana.
So, is the lesson learned here not take your dog disc golfing? 8>) This is too funny.
Nope. I think labs would even interfere with regular old games of golf!
