Tsunami victims to sue French hotel chain Accor, Thai govt, US authorities

VIENNA (AFX) - A group of Austrian and German victims of the Asian tsunami disaster are to file a lawsuit demanding that Thailand, French hotel chain Accor (Paris: FR0000120404 - news) and US forecasters prove they reacted adequately to the disaster, their lawyers said. The suit, naming Accor and the US-run tsunami early warning system in the Pacific as well as Thai authorities, will be filed in a New York district court this week, the lawyers said in Vienna.

TSUNAMI is all Americans fault

It must have been America's mad dash to the right during the Election. It upset the Earth's balance and triggered the earthquake which caused the tsunami.

For those of you still staying at the Motel 6 (despite the fact that most of them are dumps), don't forget that Motel 6 is owned by Accor, a French company. I boycott them now; suggest all do the same.

I don't think agree with a lawsuit, but I am still surprised that we could not contact anyone over there to warn them. Don't they have CNN? Remember how soon after the quake was posted on FR, that a FReeper asked about a possible tsunami? I continue to be amazed how fast FReepers are compared to the "Professionals".

If they were honest about the case, they'd sue the Thai government for incompetence. Firstly, the Thais did not, and probably still do not, have people responsible for a standing 24/7/365 automated system that calls people / triggers alarms in response to any earthquake recorded (and noted on multiple web sites) over a certain magnitude. Secondly, even beyond this failing, they did not maintain a phone tree / contact list that someone like the Tsunami Warning Center could use. Knowing what I know about both Thai culture and the governmental structure there, I am in no way surprised.

Well, I agree with the third worlders. Who else would be at fault? I offer this true story to illustrate how America is so obstructionist.

Noah's Ark II

In the year 2004, the Lord came unto Noah, who was now living in the United States, and said, "Once again, the earth has become wicked and overpopulated and I see the end of all flesh before me. Build another Ark and save two of every living thing along with a few good humans."

God gave Noah the blueprints, saying, "You have six months to build the Ark before I start the unending rain for 40 days and 40 nights".

Six months later, the Lord looked down and saw Noah weeping in his yard ..... but no ark.

"Noah", He roared, "I'm about to start the rain! Where is the Ark?"

"Forgive me, Lord," begged Noah. "But things have changed. I needed a building permit. I've been arguing with the inspector about the need for a sprinkler system. My neighbors claim that I've violated the neighborhood zoning laws by building the Ark in my yard and exceeding the height limitations.

We had to go to the Development Appeal Board for a decision. Then the Department of Transportation demanded a bond be posted for the future costs of moving power lines and other overhead obstructions, to clear the passage for the Ark's move to the sea. I argued that the sea would be coming to us, but they would hear nothing of it.

Getting the wood was another problem. There's a ban on cutting local trees in order to save the spotted owl. I tried to convince the environmentalists that I needed the wood to save the owls. But no go!

When I started gathering the animals, I got sued by an animal rights group. They insisted that I was confining wild animals against their will. As well, they argued the accommodation was too restrictive and it was cruel and inhumane to put so many animals in a confined space.

Then the EPA ruled that I couldn't build the Ark until they'd conducted an environmental impact study on your proposed flood. I'm still trying to resolve a complaint with the Human Rights Commission on how many minorities I'm supposed to hire for my building crew.

Also, the trades unions say I can't use my sons. They insist I have to hire only Union workers with Ark building experience. To make matters worse, the IRS seized all my assets, claiming I'm trying to leave the country illegally with endangered species.

So, forgive me, Lord, but it would take at least ten years for me to finish this Ark."

Suddenly the skies cleared, the sun began to shine, and a rainbow stretched across the sky.

Noah looked up in wonder and asked, "You mean, You're not going to destroy the world?"

"No," said the Lord. "The government beat me to it."

Neither the U.S. Government nor private American scientists have any contractual nor treaty obligations to provide such forecasts. They do the best they can of their own free will as a global public service.

The way to protect against such such legal vultures is for the U.S. to simply abandon all attempts at prediction in any foreign areas.

This episode also illustrates the parasitic state that Europeans have sunk to. Not only do the Europeans expect the U.S. to protect them militarily and then whine about our "militarism", they also expect the U.S. to protect them with and to pay the cost of scientific forecasts of natural disasters in a part of the world that is mostly visited by European tourists.

Where is the European Union's Tsunami Warning System effort?

I would hope that any European (don't get me started on most American's knowledge of geography) with the money to afford a holiday on the western coast of Thailand would know the difference between the Pacific and Indian oceans. But it seems that publicly and loudly demonstrating one's self to be an ignorant putz, along with dialing up a lawyer immediately after being miraculously saved by the grace of G*d, is a habit that spoiled rich Europeans share with some of us.

That is the solution isn't it. Don't know why this simple solution to Torts is not enacted other than lobbying by the Trial Lawyers. It could be implemented at local jurisdictions and I'm certain it would have overwhelming support from Insurance, Small Businesses, Property Owners and a host of other victims of the current state of affairs. Trial Lawyer opposition doesn't explain all of why this hasn't taken hold.
