The company should be able to deny smoke breaks and make the smoker pay the difference for health insurance. It's obvious that these employees habit costs the company through health care costs and the company should be able to take action. This ultimatum is taking it too far though.
It's not obvious at all! The one woman who was fired worked there for 14 years and never had to use health insurance from this company.

Should employees be denied the right to QUIT a job for such reasons? If an employee wanted to quit because his supervisor smoked, would you force the employee to remain on the job? If so, at least you are consistent, but most people would not do this. I think the employer here is stupid, but someone who owns their company has a RIGHT to be stupid like this. I hope the guy is forced by the market to change, but I don't want legislation to end the right of a property owner (like this business) to do what he wishes with his property.
They should deny all breaks and fine any employee caught with a soda or candy bar in their hands. Fresh fruit and vegetables should be mandated and only when it's not on company time. Monitors will be sent to the homes of all employees to make sure that they follow the rules and anyone caught in any unhealthy personal violation should be hauled off into the night.....
