Judge Sentences Resnick (Ohio Supreme Court Justice) Following Guilty Plea

Supreme Court Judge Ordered To Jail Or Alcohol Treatment Facility

BOWLING GREEN, Ohio -- Supreme Court Justice Alice Robie Resnick changed her drunken driving plea to guilty on Monday afternoon.

Bowling Green Municipal Court Judge Mark Reddin sentenced Resnick, 65, to three days in jail or 72 consecutive hours at an alcohol treatment center that she must complete by May 8. Resnick was also placed on a two-year probation and was fined $600. Her driver's license was suspended until July 31.

Resnick, 65, of Toledo, did not give a statement in court.

Sources close to NBC 4 said that Resnick was eager to get the events of this past week behind her.

Resnick was pulled over on Interstate 75 in Wood County on Monday.

Drivers alerted the Ohio State Highway Patrol to a possible drunken driver on the road because the Jeep Cherokee she was driving was weaving in and out of traffic.

When Resnick agreed to take the portable alcohol test, she registered 0.216 percent, more than twice the blood-alcohol legal limit in Ohio of 0.08. The portable test can't be used as evidence in court.

The incident was taped from a trooper's squad car. "I don't believe that test," Resnick told a trooper. "Do you have another test I can take?"

Resnick could have faced as much as six months in jail and a fine up to $1,000.

She refused to take an official evidentiary Breathalyzer test, which means an automatic one-year license suspension and a three-year ban from driving state vehicles. She will need a driver to get to Columbus for hearings, but the court has said the service won't be state-paid.

Resnick apologized in a statement last week, saying that she would come to court and then move on.

Resnick, a justice since 1989, is the court's only Democrat.

I don't agree.

She got a fairly steep sentence for a first offence DUI where nobody was injured.

Let's not treat her differently just because she is a Rat.

I love this 0.216 is "more that twice 0.08."

It's almost three times 0.08.

I wonder how this ratio would have been described if a Republican supreme court judge was pulled over for driving while shnockered.

She got the usual sentence, as expected. With all due respect, what did you think might or should happen? Execution and flogging are not currently permissible. She won't be disbarred as this was not a felony.

Watch the videos of the arrest, where the tries to get off by claiming she helps cops with their cases...She should be removed from the bench

Oh come on!

How many "Cops" episodes have you see where the DUI driver says the most ridiculous things?

"You know who I am?", etc.

The law MUST be applied equally in ALL cases, otherwise the law is useless.

I'm from Ohio and trust me here, she was beaten up so hard by the Columbus media that I felt sorry for her. We must have watched her pathetic OMVI videotape 50 times. She got no breaks, none. The media reveled in the bringing down of a Supreme Ct. judge.
Also for the record .0216 is closer to three times than two, but more than twice is true and pretty fair.

A Bar Assn complaint, OTOH, has nothing whatever to do with her DUI sentence.

She SHOULD be disbarred, which will take her off the bench, unless Ohio is one of those states where you don't have to be a lawyer to be a judge.

In Ohio the voters do that, the Muni Ct judge doesn't have quite that much jurisdiction.

Well, OK, I'm mollified. But still, how many times have you heard the phrase "three times the legal limit." Anyway, nice to know this wasn't soft-pedaled in Ohio. That's where it counts, anyway.

I have never seen this happen in Ohio for a first time OMVI. Actually I've never seen an OMVI lead to disbarment period (in Ohio).

Too bad for her she isn't in Wisconsin. There - a Democratic AG got to drive drunk and retain her job. When you see her today she is with a shaved head - to remind everyone that she is undergoing chemotherapy for breast cancer. Of course, I could shave my head and issue a press release indicating I was undergoing chemotherapy too, and other than being male (and we do get breast cancer, but at a trivial rate compared to women), no one would be the wiser. With medical records privacy there is essentially no way for a reporter to confirm such  a story - and one need only look at any reference to her in The Capital Times (a la "Sen. Kerry, a Vietnam Veteran") to be constantly reminded of her status as a cancer patient. Allegedly.

It is a shame that Peggy Lautenschlager is still Attorney General in Wisconsin.
