This is my first attempt to post anything here, after lurking for a time and finally registering.
I lived in Davenport for 3.5 years. In my opinion, drugs, gang activity, and the overall mentality of segments of the population are the leading factors for crime out there. Then again, it could be the boredom of living in a cornfield...sorry about that, but Davenport did not impress me.
I'll look for more information.

Welcome to FR.

Thanks for the first-hand information. I always thought Iowa was pretty laid back and crime free. I guess I'll have to rethink that.

I would say Drugs is #1 followed by Gangs/Poverty. But I am no expert.

I think it may just be Davenport, not Iowa in general. It reminded me of the dysfunctionality of Washington, DC, but on a smaller scale.
Anyhow, if you're interested in crime out there, try this link "http://www.scottcountyiowa.com/cjaac/documents.html".

I'm wondering if they could argue "inevitable discovery".
I'm thinking they had his brother dead to rights and the brother or the other accomplice would have given Daryl up.

On such phoney grounds? Are you kidding? Just grabbing someone off the street and then dragging them into the police station without ANY cause whatsoever is phoney grounds?

Based on what is in the "news release" (not much), we don't know the circumstances that led to him being taken in for questioning.

An assumption has been made that he was merely Mr. Average Citizen going about his business when he was hauled down to the police station for no reason and this admission emerged. The reporting in this story is pure crap, for starters, because the "reporter" was too lazy to give us the whole story.

So, here's what we know and/or can surmise: McCoy was taken in for questioning. He confessed to participating in the murder. He was charged and tried before a jury of his peers who found him guilty and sentenced him to prison. The jury found substantial grounds, presumably based upon the evidnce, to convict him. In essence, the SC has found that he was convicted on a technicality so, "no crime, no foul".

Sorry, there's still a victim whose family deserves justice. Based on the LACK of facts in this story, we don't know who really got any justice whatsoever.

here's what we know

The opinion was clear on what happened. Through a variety of circumstances, the police came to suspect the defendant's brother in the slaying. The police got in their cars and headed over to the defendant's brother's house, warrant in hand for the defendant's brother. On the way to the house, the police spotted a car that matched a description of the one that the defendant's brother owned. They pulled the car over, and it contained the defendant. The police, apparently, said, "Hmm, this is the brother of the guy we want...all right, close enough! You're coming to the station with us!"

So, like I said before, there is no "technicality" here. The police can't go around detaining people willy-nilly. They had no reason to suspect this guy, and they got burned. Bad police work. We know the facts here. The police screwed up. Period. No two ways about it.
